In British law as it stands if I am stopped by the police in the street ...........?

what are my rights as regards being questioned about my name and where I am going?

If you are being stopped because they suspect you of an offence they have the right to arrest you to ascertain who you are and to investigate the offence.
If they are making general enquiries and ask you a few questions, then they need a log of who they have spoken with.In this instance you dont need to talk to them, but if you were the victim, wouldnt you want people to talk to the police?

I think if your suspected of doing something then by law you have to give your details but if not then I don't think you do

You have to give your name and address, no way of getting ou tof that.

I think the police have to give the reason why they asked you to stop, there name and station they are from.

if you are stopped by the police before they ask for your details they first have to explain why you were stopped (you may fit the description of an offender for instance) if they do not do this you are not obliged to tell them anything. though i find when dealing with the police politeness pays dividends so proffering your name etc should come as no great hardship if you have nothing to hide.

You must give the information.

What is the problem I'd just tell them and save a lot of time

You are under no legal obligation to provide that information but I think those sorts of powers exist under anti-terrorism legislation

There are two types of stop that the police can do;

1. Stop and account - an officer stops you and asks you to account for your presence in a location at that time. It may just simply be the time of night or in a high crime area. You are not obliged to give your name and address, in which case the officer should complete a stops form (Gen 164) with your description.

2. Stop and search - again the officer stops you but has reasonable suspicion to search you for drugs, weapons, stolen property, terrorism-related evidence, or evidence of other crimes. Again you are not obliged to give your name and address and again a description will be recorded on the form Gen 164.

In both of the above instances if an offence comes to light you have to give your name and address. If you don't give you can be arrested if the offence is not ordinarily one that you would be arrested for anyway.

You are obliged to give your name, as for the "where are you going" bit, I dont think you are obliged to tell them though you are probably obliged to tell them where you are coming from.

cops I'm sure could arrest you and take you down the nick if you refuse to answer cos they might think you reluctant to answer means you might be guilty of something

hms jollies
you can refuse but they would just take you to the station and put you in the cells better to answer them

confucious says
YOU are obiliged to give your name and address and D.O.B.

after that nothing you are required to answer any more questions at all.
you dont have to say where you are going
you dont have to say where you have been

and also the police have no right to detain you after you have given the relevant information that is required by law .
but if they suspect you of commiting a crime or you are about to commit a crime they may arrest you but then they will caution you and tell you don have to say anything unless you wish to do so.
and a little advice here for everybody involved in crime 99% of the time if you did not speak to the police after the caution
and kept your mouth shut you would get off.
most people get convicted out of their own mouths

you want the street sense answer otr the wind yourself a asbo answer?

You dont have to comly, do anything, you can even run away if you want, same goes with questions, you can say yes, no maybe and nnone of your buisness.

But think about the guy who got shot for running away from the police at oval tube station, its a similar thing, they react like a dog, if you run from it it will follow and get out its teeth.

Its about how important it really is to you to get on your way, if you dont answer questions you could gove them suspicion that yout doing something wrong and if they suspect you they can arrest you.

a police man in the UK can ask your name address and date of birth, he will ask you where you have been and where you are going, but you do not need to tell him.
ask him or her why they want to know, and if he says i want to know why ur here ar this point, you then say, its still a free country ain't it they not made it a police state just yet have they ?
