I had a friend that this happened to. He had no weed in the car but was under the influence of it. Somehow the cop suspected this, and had him take a drug test (I'm not sure if he was arrested first or what.) My friend was on probation for a prior DUI (alcohol), and because he tested positive for THC, he got a second DUI. I know he spent some time in jail... I'm not sure how long on that either. But he described it just as if he'd gotten a second alcohol DUI.
