In England when a thief offers to return the booty to the owners are they still prosecuted?

When they are caught and they offer the stuff back is the crime automatically "wiped" without a court case? the same with benefit claimants who put in false claims if they offer to pay it back are they still taken to court.

I just wondered how it worked considering the people that pass the laws seem to operate in a strange way.

The law is fairly straightforward in respect of theft; the definition given in the Theft Act is if 'he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it'.

Criminal acts have two elements, the act itself (actus reus) and mens rea (guilty mind) so the prosecution is for what you did at the time, not what you did afterwards.

Returning the stolen property will affect the sentence and may reduce the penalty which would otherwise have been imposed.

These scummy politicians set themselves above the laws they impose on others, and then they claim to be serving the public good.

And to think Laws - the piece of **** - has the job of cutting the throats of others to save the government a bob-or-two.

It's an absolute frickin' disgrace.
