depends what state....in New York, Massachusettes and California....if its their first offence...probably not.
They will be hit with a considerable probation period, drug rehab (even if they don't smoke it), court fines, and a bit of community service.
honestly I hope that the person doesn't do jail time. I think jail time is a bit extreme for marijuana sale and usage. I would hate to see our tax dollars spent housing such a minimal criminal, marijuana is nothing but a social nuicense much like cigarrettes and alcohol and should not be treated as a criminal offense. |

It's always possible, but we don't know what kind of criminal history they already have or other factors courts look at to determine sentences. |
