So I was arrested last year when Studying my freshman year in Florida. I had about 4 grams of weed which was for my personal use obviously. So I had a court date and all that. At the court they told me to go to class and that my charges will be dropped. However I missed that class because it was right when my holidays started and I went back home to Europe.
On the wa home I lost my passport so i had to apply for new visa which is when I realized I might be in some deep S***IT. At the U.S embassy they asked me if I was arrested ( on the application I said no=) so I said yes I was but just for marijuana possession. Nevertheless he told me I need to get all the paperwork from the court so he can see what happend.
Now I am wanted by now in Florida(they issued capias). So what the hell are my options. I tried contacting the court but they wouldnt tell me anything helpfull just that they cant help me because they are the ones that are prosecuting me. What the hell can I do? I mean they can't just not give me a Visa because I was smoking pot! I just don't think its such a big deal...80% of college students or my friends at college were smoking that and even doing some things I would never done!! I mean back in Euope pills are for people that are sick and mentally unstable and that its just not me and my hobby.=))

4 grams of marijuana can NOT get you deported, unless you get convicted of sale. With that out of the way, you can be denied a Visa for any criminal history.
You said something about 'going to class and your charges will be dropped'- what are you talking about? Class as in what your Visa is for, or were you sentenced to some kind of class? If you were sentenced to attend a drug class, and skipped out on it to go home, then you're an idiot for doing so, because now you have a warrant for your arrest, and even IF you get your Student Visa re-issued, you will be arrested, which will cause you to miss class, which will violate your visa requirements, and you will be deported.
You totally screwed yourself by being a dumbass and not comlpying with your court requirements. |

"I mean they can't just not give me a Visa because I was smoking pot!" Really? Wanna bet? A visa is a privilege, NOT a right! It can be denied for ANY reason, and prosecution or conviction for a drugs offense most certainly IS one of the reasons that visas are commonly denied for.
BTW, losing your passport and visa isn't the issue here. Had the USCIS learned of the court case, your visa would have been withdrawn and you would have been denied entry into the US despite the possession of a visa.
Your only option is to retain an attorney licensed in FL to advise you. He or she can arrange a visa for you to return to answer the pending charges against you. However upon conviction the odds are strong that you would be deported. Unless the attorney can get this plead down to a non-drug related offense you're probably looking at an extended persona-non-gratis status, possibly for life. |

While I personally don't think that marijuana is such a big deal, it is illegal. (I don't use it)
And you are well aware that it's illegal and has consequences if you're caught with it.
It was foolish of you to jeopardize your situation by not attending the class, for a holiday.
Actions have consequences, as you're apparently learning the hard way. I don't think that it's fair, but it's not up to me.

Just because 80 percent of your friends did doesn't make it legal. Now i believe pot should be legal, and all non-violent drug offenders should be released from jail, but until that day comes you broke the law and need to suffer the consequences. Thats a tough situation I hope you figure it out |
