Thats an interesting question. The issue of harming a fetus inadvertently while in the course of commiting a violent crime against the mother has been explored in a number of state courts but no thorough resolution has been reached. Attempted murder requires intent. So unless a pregnant woman is attacked and beaten up and the attacker has the intent to kill the fetus, attempted murder is an inappropriate charge. Manslaughter, however, would fit the bill nicely.

if someone beats you up while your pregnant they will be sent to jail but it's not counted as attempt of murder unless they use a weapon.

Not necessarily. At the very least it's assault, and you may be able to get the other person for two counts, one for you and one for the baby.

If there was a weapon of some sort used, like a bat or a stick or a rock or something that COULD cause death, it could very likely be called AM, but unless real injury was caused, you probably couldn't make it stick.

uh, i think you can get assult for you and baby but attempted murder is premeditated... they had to have been trying to kill the baby not just trying to beat up you.

not unless he actually tried to kill you, but being beat up in any form is assault and should be reported, especially if said person is pregnant

no but its child abouse and a felony asault i would tell the police if some thing happed for your good and other pregnant women

Not a lot of info here. Sounds like it could be an assault charge - but it depends on the severity if it is anything more.

As far as the unborn child it would depend on several things - starting with the jurisdiction it occured in - do they consider an unborn child a human life or not?

That really depends on your state laws. States vary with fetus laws so that is really a hard one to answer. It could be considered as attempted manslaughter as it could have inadvertently caused death to the fetus but the state laws would have to be known to know for sure.
