i was going the speed limit,going to the back of a houseing track. he followed me but not when i turned onto the street. i got home got out of the car and was walking to the house and he pulled up. he asked me for all the info, then wrote me a ticket for tinted windows. is that even legal?

Yes. It's happened to me. If the cop does it and you cannot prove serious harm, then it's legal. And by serious harm I don't mean a window tint ticket. If he pulls into your driveway and takes your teeth out with his night stick, then you've got a case. |

If he saw you driving on the road, yes he can "pull you over" in your driveway. Sorry folks, there is no "SAFE" in the real game of cops and robbers. |

It is a long held urban legend here in California that, if you make it to private property, the police can no longer "pull you over" and ticket you. That is not true. The issue here in California is where the offense occurred, not where you happen to be at the time the police officer catches up to you. In your case, the offense of having tinted windows (which is against the law in California) occurred while you were driving through the housing area. The fact the the officer did not contact you until you reached a driveway is neither here nor there. That being said, in California that ticket would be legal. |

Yes, why should it not be. He say you driving, and was most likely trying to catch you speeding, or running a stop sign or some other violation to pull you over for.
But since you stoped he can merely call you back to the car.
Happens everyday, Home base only works in tag, not traffic stops |

Yes. You got the ticket for tinted windows and that ticket can be written even if you were just parked in your driveway, because certain states don't allow tinted windows. |

It is legal -- he probably thought you were driving drunk. Even
if a cop doesn't see you actually driving, and someone calls after you have stopped, you can still get a ticket -- can't be for speeding or running a red light if the cop didn't see you do it; but
it can be for a number of other things, DUI and too heavily tinted windows included. I've seen a cop feel a car's hood to see if it's still hot, and if the car was recently driven. |

It is irregular to say the least. He should have stopped you while you were on the street. But if you are in the wrong, it is a valid citation. |
