Depends on many factors. If her parents are letting you, a 45 year old man date a 4 year old girl, then I'm going to have to assume that would still put you behind bars.

Why not avoid the situation and have a relationship with an adult instead of a child?

If you have the parents blessing, you can do whatever you want. Even if its illegal, who's going to tell? In almost every case involving adult-minor relationship, it was the parents who ratted them out. So if you solve the parent problem your in.
