There are some states that have passed legislation making it illegal to smoke while driving if there are children in the vehicle.
I believe the laws are in effect in California and New Jersey. |

No... just advisory... the onus is on the Polis to prove that you caused an RTA through your carelessness. They have BANNED mobiles whilst driving..... thousands of 'chancers' still do it. There are distractions all over the place whilst you are behind the wheel... it's just another zealot PC thing they have come up with. |

Not yet but they get around it this way. if you have an accident when you are smoking it is evidence that you were not driving with due care and attention. The rules against smoking are getting draconian and getting to a point at which I (an ex-smoker of over 30years) would take it up again if I could afford it. |

I saw a bloke once smoking a pipe whilst driving a motorbike.
He had bored a hole through his helmet so he could sick his pipe through it into his mouth. |

To answer the question, others have done it well, but a point I'm concerned with is, haven't enough of person rights and civil liberties been regulated? Sure smoking is bad for you health, ect. but do they stop the manufacturers? It's just more control tactics, but people will smoke, will use their phones, and even drink alcohol while driving, law or no law. Smoking in their own vehicle, let them be, tossing out a fire hazard on the roads, report them. |

I think you can be charged for dangerous driving or driving without due care and attention if for instance you take your hands off the wheel for longer than necessary to light up, and of course if you let the cigarette fall you could cause an accident. I may be wrong but I read that somewhere. |

Its not illegal to smoke and drive, but its not real smart. Any distraction is unsafe when your driving. |

There are a few places where it is illegal to drive with children in the car. I haven't heard of any complete bans but it wouldn't surprise me. They have banned it in many outdoor places. |

In the UK if you are driving for a living then the vehicle is a "workplace" and it is illegal to smoke in one.
Your own non = working vehicle = no restriction.
Norway has a total ban.

IN SOME JURISDICTIONS. THE PROBLEM IS THAT IT IS YOUR CAR. AS LONG AS YOU DO NOT SMOKE AND THROW THE ASHES OR BUTTS OUT IT IS OK.
THEY TRIED TO ENFORCE THAT LAW HERE AND WE FOUGHT IT AS A VEHICLE IS MY PRIVACY.

yes law was changed about 2 or 3 weeks ago they changed the highway code to say so. Not that people follow the rules how many people still use a mobile phone whilst driving????? |
