Is it possible for this case to be DISMISSED?

I have a friend who committed identity theft with this girl in her class (she is in college)..she got arrested for buying books for 405 dollars. She hired a lawyer, and he said he could probably get her 5 felony charges reduced to misdemeanors since it was a first offense crime. Her court date (arraignment date is on November 13th, which is this Thursday)

However, every time she says she contacts the lawyer, the lawyer tells her the DA hasn't even received the files from the police yet, and they know nothing of the case until now. How is this possible? Is there something really behind the scenes the lawyer is not telling her? What is your opinion on this?

They'll get the papers there to the DA before arraignment if not she'll have to wait. They aren't in any hurry it's the due process of law. Souinds like it may be dismissed

Not a chance. Paperwork always goes slow through the police and judicial systems. Your friend is probably still going to be in serious trouble. Probably shouldn't have stolen.

I don't think her charges should be reduced. In this day and age identity theft is a big deal.

Maybe the lawyer is dragging his feet to accumulate legal fees since he knows they're gonna throw the book at her anyway.

A lot of times the DA won't get the paperwork until the day of the trial. I hope she learned something.

what state is this in? i'm not a lawyer but i work in a decent sized county jail in texas that keeps about 1000 inmates or so at all times so i'm around a lot of court things. hopefully she's not sitting out her time in jail because it's going to take a while. i get inmates ready to go to court everyday and i've been working there for a while and some of those guys i've been knowing a while now...you know why? because everytime they go to court it gets rescheduled. everytime...literally. so no her case wont be dropped. the ONLY way it can be dropped is if the courts take longer than the amount of time the law requires them to get you all the way through the system. different states different time. diff charges diff times...she's screwed though either way...cause they wait to the last minute but they always get you.

I hope she rots in jail. I HATE people who steal from others. Someone stole almost $2000 from my bank account in July. I got it back, but it is infuriating when it happens to you. Unless you're stealing because you or your family is starving to death, you should be shot.

Sounds like the lawyer is making excuses, knowing there are limits as to what he can do.

A shifty laywer, I'd say. He may not even be up to something, but that's not right. See if your friend can possibly switch lawyers because you only get 1 chance in court and then you're done. I doubt this is possible though. Tell her to keep a good record of everything he does, so that way if he does something bad or illegal she'll have evidence on him.

It's not unusual for the D.A. to see the file for the first time on the date of the arraignment.

No need to worry. Arraignment is only the 1st step. very few prosecutors review their cases thoroughly in those early stages. The only thing that will happen in court is she will have to plead guilty or not guilty. tell her to just listen to her attorney. Remember she's paying him...he's on her side.

Firstly.... That person would no longer be MY friend, that is a serious crime. The police may still be building their case? As long as they file before the statue of limitations is up..... I am no expert tho.

I guess if the DA has no files on the court date it will get dismissed.
