I was out at a baseball game with my son. On my way home, I got pulled over for speeding. A short time letter, the officer came back and told me I had a warrant for my arrest. ($100 warrant for not paying a expired tag ticket).
The officer then handcuffed me in view of my 14 year old son! I told the officer that this was a bit excessive. The officer told me tht he understands, but there was nothing he could do.
I'm just wondering why this "officer" felt justified arresting me in front of my son.

His job is to arrest anyone with an outstanding warrant. How could he trust you to turn yourself in when you couldn't be trusted to even pay a ticket? He did nothing wrong. You did. Guess your son knows that adults make mistakes also.
Instead of blaming the cop for doing his job, use this to teach your son what happens when you don't fulfill your legal obligations. |

First of all, keep two things in mind.
1. If you had appeared in court or paid the original ticket, there would not have been a warrant for your arrest.
2. If you had not been speeding with your son in the car, you would not have been pulled over and arrested.
As for standard procedure. Warrants are issued by a judge commanding all law enforcement officers in the state to place you under arrest. If the issuing jurisdiction wants to extradite you, there is nothing the officer can do.
Cuffing you in front of your son. The officer doesn't you know. Myself and most other officers have been in fights with seemingly reasonable people. I don't know you and neither does that officer. He cuffed you for his safety. Most departments have policies requiring all people under arrest be cuffed. If you don't like that....Don't have warrants for your arrest. I know that is a bit blunt, but it is the truth.
This is not an issue of what the officer felt. You had a warrant and the officer has to look out for his safety. |

That "officer" was enforcing a court order. You had a warrant for your arrest, due to you failing to appear in court to answer a traffic charge.
You were handcuffed per standard procedure, for the safety of the officer as well as your own.
There is no legal exception or rule about allowing people to break the law if their children are present.
If you don't want to get arrested in front of your son, take care of your obligations. You're a grown man and a father, take responsibility for your actions. |

What was he supposed to do, take you for a little walk around the block and arrest you where the kid couldn't see? I doubt your kid has never seen anyone arrested before.
Maybe instead of worrying about what the officer should or should not have done, maybe you should use this as a teaching moment with your son. Explain to him why Dad got arrested and that he should not break the law like you did. Tell him how important it is to obey the law so he doesn't get arrested someday too.
Also in the future, remember this incident the next time you are tempted to try to get away with something illegal. |

He "felt justified" in arresting you due to the fact that you had an outstanding warrant for your arrest! End of story!

Its nothing personal its just business. That cop doesn't know you from a hole in the wall, he doesn't know how your going to react when he advises your under arrest. |

There was a warrant out for your arrest for your failure to pay a ticket. it is not the Officer's fault you got arrested. The Officer had no choice but to arrest you for the warrant.
It is in my agency's written policies to handcuff all people we arrest. It is also good officer safety.
Tell your son the Officer was doing his job and arrested you because you made a mistake......be a role model. Teach your son responsibility. |

(what you might be getting from most of us cops here is that there's really nobody to blame here but you. Of course it's not "standard procedure"...if your son wasn't there at the time, the cops wouldn't have dragged you to where he was just to arrest you in front of him) |
