Me and some of my friends were playing outside with a tennis ball and when I threw it at one of them he accidentally hit it too hard with the hockey stick it landed on one of my neighbors lawns. So we went to get it back. Just when I was about to get it she grabbed my hand and started yelling at me saying that it was hers because it was on her property. She let my arm go so I fell on the ground. I just apologized and left. It was only a tennis ball that I found. Im just wondering, is she allowed to really keep it? Why would somebody react like that anyways? We are only 10. Its not like anybody has ever accidentally kicked a ball near her house.

Sounds like a frustrated old biddy, and I agree, you should tell your parents and write to the newspaper to show the whole town what a petty-minded and irrational woman she is. Also you should make a big deal out or her putting her hands on you. Maybe you can sue her for assault on a minor. Miserable people like her need to be made as miserable as possible. Just don't break any laws doing it. maybe the police can go talk to her and tell her if she doesn't give the ball back they'll arrest her for touching you. |

It sounds like your neighbor over reacted. It was just a ball, as you say, but it landed on private property. She can keep it, if she so desires. You can't prove ownership. And the issue is not worth pursuing.
Your apology was wise. Your neighbor should have done the same since grabbing your hand and yelling wasn't really a nice, or wise, thing for her to do. |

Your are ten? She should have never touched you! Tell your parents so they can file a police report. She is in trouble not you. Even if the police doesn't do anything, at least there will be a record of what she did on file, so the next time she tries to grab the arm of a child...something could be done. Stay away from her lawn, find another place to play so balls do not end up in the disturbed woman's lawn. By the way the balls are yours not hers. I am so impressed with your writing and spelling, much better than some of the older folks on this site! |

You did the right thing by handling it the way you did - calm and polite and not letting it escalate.
She had no right to touch you physically. Nor did she have a right to take your property as it was not 'left' on her lawn.
(That would be the same as your driving on the sidewalk riding your bike and you accidently fall off your bike and land on somebodies lawn. Could the person then run out and scoop your bike up as theirs because it landed on their property>? No way Jose!)
Technically the woman can be sued for assault and battery for grabbing your arm and if you fall on her property- she can be sued! It's her responsibility. So....
I would just stay away from her, but if she ever bothers you again than know your rights and act upon them. |
