Some very good definitions of different charges above me, but I have to respectfully disagree with above posters who state there is NO difference between the charges. If there was NO difference, there would not be two separate charges.
DUI ( Driving Under the Influence) is a BAC of .01 to .07.
DWI (Driving While Intoxicated) is a BAC of .08 or higher.
That is the actual and technical difference between the charges. How each state deals with the two can be either different or the same, but the BAC will determine which charge is appropriate.

DUI - Driving Under the Influence
There is no difference between the two. Roughly 40 states in the US enforce a DUI as the offense. The other ten states enforce DWI (Missouri, Texas, New York, Minnesota, Connecticut, New Jersey, and New Hampshire, all DWI states NOT DWI).
There are also other states that classify the offense as DWAI, OUI, DWII, OWI.
DWAI (Colorado, which also enforces that DUI)
OUI (Maine)
DUII (Oregon)
OWI (Indiana, Michigan)
You can't be charged with a DUI pr DWI in these states, other then Colorade which is enforces two of them. |
