There have been no reports of it happening. However, the defence for a charge of careless driving is that you have been driving according to the Highway Code. The latest version of the Highway Code recommends that you don't smoke whilst driving. So it's only a matter of time. |

Providing you're in your own car and that car isn't used for any type of work, then - no! But it's illegal to smoke in vehicles that are used to transport members of the public or if they are used by more than one person for the purposes of work (paid or unpaid), whether they are travelling in the vehicle at the same time or not. (eg., a works van). The ban also means that it will be illegal for both drivers and passengers to light up in all taxis and private hire vehicles. This means that drivers will not be able to smoke in their cab, even if they have no passengers. |

Yes. I heard on the news today that there is a fine for smoking in your car in the uk. Here in Ireland we can smoke in our own cars but not in company vehicles like vans and trucks or Taxi's. |

Depends what you're smoking and how big it is, the main thing is keeping your eyes focussed and your hands on the wheel. Oh! and don't laugh at the policeman when he arrests you. |

The answer is it is not an offence but if you have an accident whilst smoking it could well be taken as driving without due care and attention. The same applies if you are eating or having a drink (non alcoholic) |

You won't get find for smoking unless the police think that you are driving without due care and attention whilst you are smoking. |

I know they're cracking down but I'm not sure that they actually follow through on the fines these days - not yet at least. |

Only if they can show that as a result of your smoking that you were not in proper control of the vehicle, i.e some evidence to show that your driving was adversley affected.
Also if its a works vehicle....... no smoking in the workplace!!!!!!! |

No. It is still legal in your car, with the exception of on the property of someone who has an outright ban on their property (there are a few businesses who have "no smoking on premises") |

I think the new Highway Code, published today, prohibits smoking while driving but don't think it is enforceable. Certainly, you can be fined for throwing a cigarette end out of your car window. I have seen such cases reported in the Yorkshire Evening Post newspaper. |

Just heard this garbage on the news. The next thing you won't be able to do in your car is to drive.
I gave it a lot of thought and came up with this idea. Why doesn't someone invent a wooden box, attacah two wheels to it and two things sticking out the front where you can somehow attach an ox or similar creature and sit in the box and be pulled along like that.
Do you think such an idea would catch on?. |

There is a fine however for smoking and the police think that your smoking is causing 'driving without due care'. |

Probably. In the UK you can be fined for smoking whilst driving a company vehicle (I guess that could include your own car if you use it for work purposes), and you can be fined for throwing your butts out of your car window. I guess if the police felt that by having a cigarette in your hand meant you weren't properly in control of your vehicle then they could fine you for that too. It won't surprise me if they do eventually declare tobacco an illegal drug. |
