If a person intent on committing suicide by jumping off a building, jumps, has a heart attack on the way down as is often the case, but is hit by a stray bullet from gang violence before hitting the ground, does the state view it as a homocide or a suicide?

This would be a suicide.
In the situation you mentioned, the heart attack was caused by the jumping off of a building, which was a suicide intent by the jumper. Whether the person died of a heart attack on the way down, or died upon impact, it was all caused by the jumper, meaning it was a suicide (at the very least it would be natural causes if the heart attack was the deciding factor upon death). The gunshot would have had no effect on the death of the person because they were already dead by their own doing prior to being struck by the stray bullet. |

I assume the state views it as whichever event kills him first. Probably the fall as a heart attack and most bullet injuries would take a while to kill you. |

What a bizarre scenario...but I'll attempt anyway. First, the law is not strictly objective. What one PD or DA may decide to pursue one way, another may refrain.
However, my best guess...if the autopsy revealed that the person died (say of a heart attack) prior to being struck by the bullet (and yes, they can tell) then you wouldn't be able to charge the person firing the weapon with homicide--they didn't kill anyone, only shot a dead body. You could still, however, charge them with reckless endangerment, etc.
Overall, to really make a homicide charge stick on this, you'd have to prove that the person was still alive when they were shot, and died from the gunshot wound, not the heart attack or the fall--not an easy task. |
