Lets say someone gets pull over and they leave the cd player playing and they are singing when the officer is standing right there. And that person tells the officer to wait so they can finish singing the song. The song is one thing leads another by steven strait.

No... There is no law against making an a** out of yourself as long as it does not endanger others, in this case a policeman. The policeman has to use his authority wisely and with some restraint. I guess that there could be an argument that the officer could "arrest" the driver for some kind of obstruction... BUT a judge and/or prosecutor would throw something like that out. What municipality would want a headache like this? especially over a traffic citation?

You have to consider that anytime a officer arrests someone they also have to escort the individual to jail, process him, and write a full report and file... then maybe have to show up (on their own time sometimes) to the court date. That officer would have to be very angry to go through something so arduous that would eventually be thrown out. Not to mention that his performance might be reviewed for something like this.

The person who answered above is right though (or it is true in the States too)... you must provide ID. But I guarantee you that the officer (nine times out of ten) will try to convince you to cooperate first. And there would be no chance for driving off with a warning... you'd get a citation for whatever he pulled you over for.

I think the officers would consider that as obstruction of justice. Because you are getting in the way of them doing their job. So I guess it is illegal.

Here in Ontario you must identify yourself when asked by a police officer, if you ignore the officer when asked this to listen to a song you will be arrested.

Any chance of getting a break from the officer (reason he/she stopped you in the first place) would be gone as well.

not illegal at all. but some of these awnsers should be.like the folks that would be miffed that u didnt bow immediatly to there athority and would write u a bunch of bull***t tickets because you hurt their pride.f-that.

I could be called resisting! If I was a cop, and someone did that to me I'd tell them once to step out of the car or I was going to taze them. Than if they didn't I'd just taze um.

And yes, it's illegal, you're required to follow the instructions given by the officer.

You are required to follow the officer's instructions. Failure to do so can be construed as interfering with an investigation or obstruction of justice. For the policeman's protection and your own, you should comply with the officer's requests.

Someone could use loud music to try to distract the officer or prevent him from hearing something that could harm him. It is your duty as a citizen to cooperate with the officer.

This country is loaded with people who understand their rights but have no idea of the responsibilities that go along with them.

Hey Maxhound,how about a ticket for obstructing/delaying a peace officer in the performance of their duties? Don't forget to cite for whatever they were pulled over for in the first place and any other vehicle code violations that might be present.

Maybe a ticket would be inappropriate....since obstruction is a misdemeanor, maybe going to jail would be a better course of action.

I dont know if its illegal, but you might find your time being wasted by the officer who will run every check on you rather than letting you off with a warning.

While making the officer wait for a couple of seconds for a song to finish may not be illegal in itself, - if they would make him wait for an extended period of time I am certain that he could and would charge them for obstructing justice. - and they would certainly deserve the ticket!

One would have to be an absolute idiot to do this!

Is it illegal? I doubt it. Is it wise? Definitely not. How do you prove you didn't cross the center line, or were not speeding, or anything else? Not to mention if you are this disrespectful, what other issues there may be to make up or have for you in real.

No, I'd just go back to my car and write a bunch of tickets, to make sure that the song was over by the time I came back.
