just wondering what sort of sentance i would get
i hit him in the face and whilst he was down i kicked him..
we were both a bit drunk and a few words were thrown around and one thing led to the other
oh and it could be seen as racial attack..
what sorta time will i be looking at?

Anything from minor assault to GBH.
If it is classed as a racially motivated attack then any punishment is likely to be increased.
Penalties could be from a relatively minor fine to a couple of years inside.
It is difficult to say with any certainty as it can depend on what you get charged with (if at all) and what the judge feels like at the time.

The first thing you need to do is ge a lawyer & second: STOP TELLING PEOPLE THAT YOU DID IT> The number one reason that people who are accused of crimes are convicted is because they either make an admission to someone who testifies against them or they make an ill advised confession to the police. Save confession for your priest.
It all depends on so many variables, what state are you in? How badly was the person injured (if at all)
A battery in the unlawful touching or striking of another without their consent. If they did not sustain serious injury it is a misdemeanor and people seldom go to jail (unless it is domestic violence; however if the alleged victim suffered severe , permanent injury or damage you are looking at a low grade felony. If you used a weapon and caused serious injury you are looking at a big time felony
talk to a lawyer, chances are since he was drinking as well, he will not follow through on filing a complaint. If there were no witnesses, the DA is reluctant to go to trial on a "he said, he said case"

As usual it's going to depend on your country/state. At least in NSW it's unlikely you would serve time if you had a pretty clean record and he wasn't hurt too badly, and that's assuming you're convicted.
General rules:
1. Don't talk to police if you can help it. Rules change from place to place but generally you don't need to make a statement or make admissions. You can simply say "I don't want to make a statement". Sometimes it's good to add "I don't want to be recorded refusing to make a statement". If police can charge they generally will. Giving them the evidence they need in your words just makes their decision to charge a lot easier. Police still have to plan to get a witness into court for evidence.
2. Get references. Good references say they're aware of the specific charges. Employers are good (you have to tell them what happened, but the court likes it if you face up to it in society).
3. Get a lawyer. Legal aid might be able to help, usually you'll be eligible if you're under 18 or are on welfare benefits of some kind.
Racial is a very seriously aggravating issue and you might have to face up to that at some point, and being drunk won't be an excuse. At the end of the day it's going to depend roughly on which court, which jurisdiction, and which magistrate. In some places you won't get a custodial sentence unless the magistrate doesn't feel like he has an appropriate alternative (community service / fine / etc). Get a lawyer. |

It depends on the charges. Until you are charged with something there is no way to tell you how much time you could be looking at. I suggest not drinking anymore for starters. You obviously cannot behave when you drink.
If it is a misd. you probably will get probation if it is a first offense and if you stop drinking and if you have an atty. If you are charged with a felony, you may do some jail time but how much depends on the judge, the witnesses, the charge, your atty and you.
If you want a range for any charge you could get her goes: slap on the wrist to 15 years. Big range, huh? That is why we need to know the charge.
And he can also sue you civilly.
You should quit drinking and work as much as you can, even a part time job or a second full time job. Start saving up. You will need the money for bail, atty, court costs, etc. And you can't get in to more trouble if you are at work, lol. |

You hit someone in the face and while he was down you kicked him? Regardless of the reason this incident shouldn't have happened. The only impression you have made is that you are a bully. You don't know how to walk away from a confrontation. I hope the other guy is alright. If you do get any time for this crime, you will be taught a lesson in jail. |

first offense 2 to 5. for assault. being that you kicked him when he was down not good a good idea. judge will not like you and hand out heavier sentence. jail plus fine so you'll probably get 1 year 2ooo$ fine, off in nine months for good behavior and maybe nine months probation... |

Now when asking his question it is a big help to let us know what country you are in as this is the British Yahoo can we take it you are in England or Wales thing are different north of the border in jolly jock o land. Personal I would see if anyone saw what happened and can come to your defence, but what he said when it happened and what he does can be two different things if he goes to the police and it is on CCTV and he has done nothing well pal you are in it up to your neck? Also is this your first offence? And racial motivated attacks are more serious just hope he does not go to the police, kicking a man when his down goes down like a brick plus it is a cowardly act. I think the max is about 6 years but that is the maximum sentence and then if you do get a custodial sentence few if any serve their full time. The link below may help you? |

First offense 6 months in jail.
Second, 1-7 years
If you're a habitual offender you could get life.
Assault and battery is serious but your friend would have to press charges unless the state (the DA) picks it up as a hate crime.
Then you have to worry about big Bubba in the shower.
One of my best buds got 6 months for breaking a guys jaw after the guy fondled his girlfriend. It was his first offense. |

Well, it depends if it was a 1st degree assault of 2nd degree assault. If you were planning on it ahead of time, and wanted to hurt them badly, I would say between one year to 3 years. Unless you mortally wound the person. It also depends if you were provoked. Let's say you just hit him, and kick him once, and he gets off and on his feet in no time, I would be, either a precausion, anger management sessions, or maybe the most would be 2 weeks. |
