Just got a speeding ticket...have questions!!!?

I got pulled over for speeding 60 at a 35 mph area. The cop who pulled me over was sitting on a left turning lane into a community. The lane she was sitting on had no lights or stop sign. She was sitting there without her left tun signal on or any hazard lights on. I was wondering if what she did was illegal?

i know i was illegal but was she also illegal by sitting there with no turn signal because cops r supposed too obey the same laws as citizens

It would be illegal if all she was doing was sitting there. In almost all States, the police are required to obey all traffic laws just as ordinary citizens, unless they are in pursuit of a violator or responding to a call that requires a response that makes it necessary to violate the rules.
I have had trainees that believed it was ok to speed, park on the wrong side of the street, and etc. I make them read the State law that requires them to follow the rules. If they don't comply, they don't get a passing evaluation. They can't come back later when they get a complaint and say that they were told it was ok. |

Maybe, but what's that got to do with your speeding ticket? It doesn't cancel out the fact that you were going 25 miles an hour over the speed limit. |

You didn't say what state you were in, but most states have an exclusionary clause in the law for police, which allows them to disregard certain aspects of the law as long as it is being done to further a police function, such as detecting traffic violators. It just has to be done with due regard for public safety. Basically, if no one got hurt because of it, then it was legal.
That ticket for 25 over is going to hurt, some states you would lose your license and have to go to jail. If you saw her well enough to know she was sitting in a turn lane, with no turn signal on, then how fast were you going before she got the radar lock? |
