Third Drunk Driving Conviction
If you are unfortunate enough to receive your 3rd drunk driving conviction in Illinois you will receive a minimum 6 year loss of your driving privileges and you may be imprisoned for up to 3 years. In addition, you will also receive a maximum fine of $10,000. If, at the time of the third violation, the person was transporting a person under the age of 16, the driver is guilty of a Class 4 felony and shall receive, in addition to any other penalty imposed, an additional mandatory fine of $1,000, an additional mandatory 140 hours of community service, which shall include 40 hours in a program benefiting children, and a mandatory minimum 30 days of imprisonment.

plea bargain? that was the first time.
thoughts? congratulations, you've made it. 3 DUIs is the mark of an accomplished alcoholic. the big problem here is that statistically the next traffic problem you have while drunk will probably involve the loss of life. statistically you are one drink away from killing someone.

You didn't learn your lesson after the first one? You need to get a lawyer. And remember what designated drivers are for. If you can't control yourself and not drive when drunk you should be prepared to suffer the consequences. What if you wrecked and killed someone because you were too drunk to maintain proper control of you vehicle? Some judges will go easy on you for your first DUI if you get help. Your third, don't be surprised if the judge takes your license for life and puts you in jail. Illinois law will dictate just how harsh the judge can be. Your best bet is to get a lawyer and join AA to get help with your alcoholism. And yes you qualify as an alcoholic because your drinking is overriding your good judgment. |

No you cannot plea bargain. No judge will even hear your case after your 3rd offense.
I don't know about Illinois but here in Maine, I believe 3rd time is mandatory 6 months in jail, 10 year license suspension, and many many many thousands of dollars in fines.
It is not avoidable. |

Have a lawyer try to convince the cop to settle the charges, otherwise I doubt it. One more DUI will make you a Habitual Violator and that turns into a Felony. |

Look up DUI in your state's Criminal CODE (GOOGLE IT!) heres a site that may help http://www.myillinoisdefenselawyer.com/ there is a dui link on the left side of the page. To be honest it looks pretty bad for you, but the only thing that may save you is taking some kind of program. they have home monitoring (ankle bracelet) alcohol classes, community service... a hell of a lot... or even haveing them place a breath test ignition lock in you vehicle. you can usually get that if ALL your DUIs were in YOUR vehicle. DUIs are a hard thing to fight, but you can fight for the best sentence anyways. As for plea bargaining for a better sentence on jail time, the only way is taking jail time WITH one of the programs previously mintioned. Hope this helps... GOOD LUCK! hey, and no more DUIs huh... |

Yep..... they stiffened the rules.
You will be going to jail and you will be losing your license for many years. It will be very expensive now and in the future. Third is now a class 4 felony. Employment wise that could become an issue later. Insurance wise you are screwed.
If I was you I would get a very serious and expensive lawyer. Borrow the money, sell your stuff, sell your car, cash out the 401K, empty your bank account or whatever to afford it.
A good lawyer can do amazing things. A super cheap lawyer does not have the same clout in a plea bargin. |

Illinois just 'stiffened' the penalty for YOUR FIRST DUI., you (on your first) have to install a breathalyzer into your car. For your 2nd it is a felony with MANDATORY jail time. Your third, you could have to go to prison. They will penalize you 'hard' for this. It is a felony and you are considered a criminal. Those who commit crimes, especially habitually, are criminals. You won't be driving for a long time. You will have to be counseled and go through treatment and it will cost you thousands of dollars... then they never HAVE TO GIVE YOU A LEGAL license again. It will cost you dearly. |

For your third DUI you will probably see some type of jail/prison time. You should be, if not upgraded later, to Aggravated DUI. There will be some jail/prison time with your sentence.
With the new DUI laws that took effect in Illinois January 1st, it will be harder for DUI offenders to get any leniency from the courts. Rest assured that your drivers license will be revoked for life.
Plea bargains are always possible. That will be determined between the attorneys. I would think that at best, you will be sentenced to jail/prison but have confinement suspended unless you get into legal trouble again.
