Just got pulled over...help?

I just got pulled over and was said to be doing 69 in a 40 but I don't even know how fast I was really going because I was not looking at what speed I was doing. The cop said he could take my liscene away because I was going so fast but instead he was going to give me 2 points. He said I don't have to appear for a court hearing to just pay the fine and send it in. But I really don't want the two points. My boyfriend said to plead not guilty and tell the judge I would gladly pay the fine if he could just get rid of the points. I don't know what to do it was my first time ever being pulled over...anyone have any suggestions? thanks.

I don't think the cop used any radar gun it just says his name for speed device used
Also, the road I was traveling on, I have seen people do 80 on. It was early in the morning and I was the only one on the road. I think I was an easy target.

Why on Earth should you not get the points ? if nothing else not being aware of your own speed makes you an incompetent driver. Keep this up and sooner or later you will lose your license.

Now grow up. You were pulled over for a legitimate reason. Pay your fine, get the points and use the experience to become a better driver.

BTW, your bf's advice is idiotic. You can only pay the fine if you are guilty, and if you are guilty you also get the points. It's a package deal.

you cannot plead guilty without having the points deducted. I am aware of the concern of points but speeding is a serious infraction so i would plead not guilty and appear in court and explain your story to the judge and if foung guilty, then request if you may take some sort of driving course(defensive driving) and that would help in restoring those points.

You always have the right to plead "not guilty," but the judge may, if he finds you guilty, fine you up to whatever is the maximum allowable fine plus court costs. You will then have to pay all that plus have the points. You can ask the court about going to driving school to get the points forgiven. Its a free country, you can do whatever you want, but you need to check with your local authorities to see what your choices are and what the advantages or disadvantages are to them.

Ok...let me tell you what will happen.

The judge is NOT going to "deduct" the points.
Your preference in this matter is not relevant.
In court, there is only guilty, or not guilty.
There is never "guilty with a a good reason".
If you try this, the judge will hit you for the max in points, fines, etc. And it doesn't matter what other drivers do...you were the one they caught.

PAY the ticket, and save yourself the humiliation in court.

You can plead to a lesser offense, such as failure to obey a sign, but he probably thought you were going faster than 69, since if you were ticketed for 70 he would of had to of added other charges and had your car towed and you would of had to come up with bail, etc. Paying the fine is not really optional. If other people are doing 80 on the road, that is prob why there was a cop there.

You can go to court and ask to plead to failure to obey a sign, but I doubt they will cut you anymore slack. They may tack on court costs if you lose, which can be another $100 or so.

I don't think you can win the case. The policeman stopped you for a reason...called speeding :-)

It's a "moving violation", I'm not sure if they'll allow you a traffic class. It's going to cost you. Almost 20 Mph over the limit ?

Was the cop using radar or a laser? Did he record you?

If so, then you may as well pay the fine, take the points, and be glad he didn't take your license.

Your boyfriend obviously isn't a lawyer - you can't plead 'not-guilty' and pay a fine in a plea. And, the points are going to happen. Ignore your bf's advice - he doesn't know what he's talking about.

Just be glad you still have your license. Going 29 mph over the limit in this state (WA) would have gotten you arrested.

Addendum: If you go in there and plead 'not guilty' I'm going to guarantee you they won't cut you any slack - you're as much as lying to them, telling them you didn't do it. However, if you plead guilty, and ask for mercy, they may cut you some slack on the fine, but you'll still get the points.

your boyfreind is right. points can be very costly in matters of inurances and the accumalations of them will cost you the privladge of your drive lic.however when it comes to the court systemand negotiating a deal it best to uase legal counsel (a attorney) good luck
