Last night a drunk driver hit a tree in front of my house?

The police came and arrested the driver. This morning I was cleaning up some debris and I found two small containers filled with marijuana and ?. I wasn't sure if I should just throw it out or call the police to come get it. My neighbor told me just to throw it out. I decided to call the police. My neighbor said that now the officer who took the report will get in trouble for missing the drugs. Is this true? It was at night and it was dark. I feel bad now that I called.
Additional Details
lol oldmarine-- My neighbor told me to smoke up and enjoy. Finders keepers!

Lets make this clear...the officers not seeing the marijuana in the dark will NOT get them in trouble!

Do not feel bad! You did the right thing!

the officer won't get into trouble for missing that one on his report. as long as it was established on the spot that the driver was drunk at the time of the arrest, that will be the focus of the case.
unless they want to nail the person on drug charges...

It is too late for it to be a factor in the DUI. If it does become an issue, it will get thrown out.

It was night right?

I don't believe so. It may just be that the person hid the drugs & they weren't able to be seen until the daytime. Officers are human & you did the right thing reporting it.

Sorry that that happened to you.

I wouldn't feel bad. I think you did the right thing. They probably tried to throw the drugs out before they got in the accident. It's not like the guy got away because they didn't find the drugs. Trust me, he has a long couple years ahead of him. I doubt the officer will get in any trouble.

You should call the police! You need to put the drugs in a ziploc bag and then put it into a paper bag.
If you throw it out, that would put you in the place of an accomplice because you destroyed physical evidence.
The officer will probably get in minor trouble. Mistakes do happen. The extra evidence that you know hold, could make or break his case.

CALL THE POLICE AND HAVE THEM COME TO YOUR RESIDENCE TO TAKE CONTROL OF THE NARCOTICS!!!

The officer will not be in trouble. It was dark and what he was dealing with was a drunk person, possible injuries and the car itself. No need for CSI like people. Missing drugs? Sure, the guy is not going to tell the officer or the judge that he had drugs. So what is missing?

You called it in so obviously the officer did not pocket the drugs.

The guy had balls to show up at your house. He might have been fishing to see if you found something else of course. My bet is that the cellphone has numbers on it to call who he gets the drugs from

If the police had showed when he was there or just left they would have nabbed him. Then you would have possibly gotten into trouble.

You did right. Guy was drunk enough to hit a tree so he could have killed somebody. Guy has weed so that adds a layer to that. So he is not even a smart criminal when breaking the law.

It could have been you on any given night. Your neighbor might think they are funny but they are foolish.

Don't you had to make a value decision. You didn't make it lightly and you didn't do it to get the officer in trouble. The officer will probably not get in trouble unless he has a history of missing evidence. How would you have felt if through it out and did not report it? The marijuana will probably have little bearing on the case against the driver.
However how do you feel about destroying evidence?

I would have kept it!

pffffffffffff.... smoke it... I would consider it good luck. Although, it definitely cannot be added as evidence now. IF you don't like it you might as well sell it. Such uptight losers on yahoo answers.

Probably should have just flushed it down the toilet. I'm not sure if the cop will get in trouble for missing it, but if they already have the guy for drunk driving, a couple containers of pot aren't really gonna do anything, especially since they probably can't prove it's his (since you were the one who found it and they have no way of knowing if it was from his car or left behind by someone else). I mean, it's just pot... not like it's meth or crack.

Why didn't the cops search the scene right after the accident? You were right to call them.
