if u were a cop...and u lived in the state of Maryland...and you searching a car because sombody called in a report that the kids in the car were smoking crack....and you found a old smashed up roach in the ash tray...with all the black n mild ashes around it.....would u arrest the driver and give him charges of possession??? answer plz

Maryland Law for possession is about 28 grams.
See Criminal laws 5-612-Possession, Distribution etc.
Now, that said, I could book everyone for being under the influence (DUI, PUI etc) of the substance, use the substance as evidence and give a ticket to all for that? |

youre in posession of a controlled substance hence breaking the law. Depending on your drug regulations on amounts and legalities of what, and your previous criminal record if you have one.
i think he has the evidence of drug use to make an arrest especially if you have any priors. Which i would guess that you have.
But you are in possession with having a roach in your car. |

possession is possession, but your lawyer should be able to get you out on probable cause, since a phone call is not justification for the search. |

if they can prove that it had pot in it then yes but u wouldnt get arrested for that small of an amount |

would i or could ? i personally would not, however i certainly could. if you are in possession of any amount you can be charged. one seed and you can be charged. the residue off a cigarette paper or pipe.you could be charged with possession of paraphernalia. if they have enough residue to test they can charge you with possession. |
