Lying that you haven't been drinking when you have when you get pulled over?

Hypothetical questions:

So your drinking, not that your drunk but you had a few at lunch. If you get pulled over and officer asks if you've been drinking, say no (which you have) are there any consequences? I figure if you say yes, your for sure getting a DUI, and if you say no, you at least chance it, but then if you get a DUI you also get lying to a police officer. Any thoughts on that? I'm also in Minneapolis, MN if that counts.

I got a DUI once, and in the county mandated class that they sent me to for my rehabilitation, the counselor there told me that the best answer to give the officer is - No officer, I don't drink and drive. Whether or not this is consider giving false information to police I have yet to discover. But I do know that you are never required to answer there questions AND they can't use anything against you in court until they read you your rights. Saying no to drinking, as far as I understand the law, is not admissable in court. As far as hoping for leniency from the officer, it depends on the cop. In my case, he pulled me over for a BS reason and I thought admitting to and being honest about having a couple beers would either make the cop or DA go easier on me. Neither did. The cop used his full abilities to conduct FSTs and the DA said that because I admitted to drinking, there was no reason to cut me a break and they were going to push the full fine and charges of DUI, which by the way was only a .09; I wasn't impaired, but a number's a number. Basically, the DA said that because I was honest, respectful and polite to their law enforcement agent, I deserved the full punishment. Had I lied my ass off or answered nothing at all, the DA would have been more likely to cut me a deal, or the cop would have let me go. In hindsight, I wish I had lied, and I wish I would have been more of a dick and made the officer admit that he had no actual reason to pull me over. It's up to you and how lucky you can get with your honesty. All in all, the law is never on your side. I thought telling the truth would make things easier on me down the road. I was wrong.

you'll take a field sobriety test and most likely flunk. this a "gotcha" society and in this case cops are like rabid dogs looking for a sniff at a bone, so your gonna be guilty.

lol this happened to me. i said 'no' when i really had been drinking, and then the cop was like "well, i smell alcohol on your breath", and then i was like "ok ok i was drinking". and i got a DUI/MIP - which is a crapload to pay off. but i didn't get anything for lying to a police officer, but i think that's because he could see that i wasn't drunk (i hardly had anything at all in my system), and i made nice conversation with him as he was writing my ticket lol.

My ex fiance lied about it like ten times and they just got him for a D.U.I. They can do that, but most of the time they don't.. He spent 14 days in jail, had to pay over $1,600 for his fines and lawyer, and he lost his license for a year.

It does not pay to drink and drive and you can kill innocent people.. I used to drink and drive when I was younger, but I haven't for three years now. (I am 26, my pic makes me look younger) I wouldn't do it again for nothing.

I was 16 years old when I got my first DUI. I totaled a car drunk when I was 17 and got another one.. I was very stupid. Don't drink and drive. Not only will it mess up your life... It can mess up other's also.

The standard answer is "I only had a couple" .. If your not really drunk, then you won't blow over the limit. Depends on the mood of the cop, but honesty is refreshing, they get lied to all the time, and you're better off being honest and respectful.

No you can't get in trouble for telling a lie, but of course if your over the limit then you will be done for being over.

A simple thing would be to buy your own breathalyzer kit and take it with you when you go out.

Lol dude once i got pulled over by a tank and i got a second dui when I was lying it was my first and hahaha they took me to the commanding officers of the soldiers

When it comes to getting a DUI, there's something I wanna let you in on. Have you ever heard of anyone getting charged with lying about being under the influence? I know I haven't. And many people do lie about it. I know I would if I was ever in that situation. The main thing is, if your BAC or blood alcohol content is within the legal limit, you're fine. But no. People do not get charged, or even get a harsher punishment, if they lie to a police officer about having anything to drink.

i have never heard of people getting extra charges for this, but it sounds like you are planning on driving over the Blood Alcohol Limit

DON'T

If you cause an accident while over the limit, your insurance will not cover you AT ALL and you might have to spend the rest of your life paying for other people's injuries and lawsuits. it is never worth it to drive over the limit
