what is the different between misdemeaner in traffic violation and misdemeanor criminal?

Hello Alex. I will respectfully disagree with the above poster. Any moving violation ticket you get is a misdemeanor charge. This is considered non criminal and as such, a citation is issued and you answer in court ( no finger prints are taken in this type of action).
If you are involved in a misdemeanor accident for culpability on your part, you would be arrested. In this scenario, you are being charged with a motor vehicle misdemeanor, but it is also a criminal charge, so prints would be taken .
A traffic citation is not expungable. ( Speeding, running a light, no brake lights, etc). The citation disappears off your driver's license abstract after a few years.
If you are referring to a criminal misdemeanor, you can get them expunged in most jurisdictions if this is a first offense. You usually need to be free and clear of all legal encumbrances for a year to qualify. You can check with your Clerk of Courts to see if your area allows expungement of misdemeanors. They would also have the motion packet to fill out.

Yes, fingerprints are taken in both cases if the traffic violation was serious.
At a small traffic violation, you can get away with just a ticket and no fingerprints are taken.
At a criminal misdemeanor, you never get away with a ticket, but just with a bond and your fingerprints are always taken. |
