The plaintiff has the burden of proof...which means it's up to him and his lawyer to prove the defendant's guilt. We are innocent until proven guilty (or so they say.)

If you can't answer this homework question, then quit the class. In fact, if you couldn't have answered it before starting the class, then you have no chance of passing.

The truth is rarely an issue in courts. Typically it has more to do with how good your lawyer is. The burden of proof is the responsibility of the prosecution to show beyond a reasonable doubt that the defendant is guilty.
So A would be the closest choice.

"Burden of Proof":
Has nothing to do with "TRUTH"
It is the FACT(S) at trial that have to be proved. Burden has nothing to do with the truth in a matter, just the plain, hard cold facts of the case.

wouldn't this question have been better answered by doing your own research? Now you don't even know why the answer is what it is.
