I'd be more concerned about the reason my 11 year old was arrested than trying to find out if he was illegally searched. As long as he has you pursuing the rights and wrongs of his arrest he won't have any respect for the law. |

The police may have been worried about weapons. If I was a cop dealing with a very bad child I'd be checking his pockets too, appropriate adult or not. I'd rather get in legal trouble than shot or stabbed.
I'm not sayin your child is bad but I've seen some pretty bad ones that scared the hell out of me. |

Kids these days annoy me so much, you gotta be careful wherever you go. You go somewhere alone and out of view these days and you end up getting beat up and/or knifed and/or shot. It's f*cking rediculous! If I got my hands on them I'd stab them half to death to let 'em know how it feels, bunch of tw@ts! Seriously, someone getting arrested at 11?? They're getting younger everyday, something needs to be done about them! If I were you I'd be more bothered about making sure my child never did that again rather than seeing if him being searched was legal or not. I'll tell you one thing, I would search him regardless 'cause you never know what they're carrying. |

As far as I'm aware, they can do that - I'm not sure of the direct citation but under new laws (I assume you're from the UK), they can search anyone on the street under several laws (including the newly acclaimed anti-terrorism law / right).
These days, the Police can stop and search anyone if they have a reason to do so - there are reasons which do not pass though, such as "They're black, they must be causing trouble". It must be justified, if your kid was loitering, he may be believed to be in preparation for a crime etc.
As long as they provided him with a record of his stop and search, it's all legal.

i would think they could if they believed he had a weapon or something dangerous.
i think boris has allowed police to search without reason now. which i agree with, i dont want people wandering our streets with guns and knives
is it such a big problem anyway. if he had nothing to hide wheres the harm and if he did have something to hide im glad they caught him. |

look anyone arrested has to be search your child (which you think is such an angel by the sounds) could of been carrying a knife, so waiting for you to turn up would be crazy, not against tihe law. also about the phone calls, ask your son if he gave your number straight away, if not then thats why, if yes then hes lieing as believe me police offciers dont really want a young kid in the jails as we know he willnt get any more done about them as they are to young.
bit of advice, no point taking it futher with the police as its not their fault your child was pointed out. just be happy your boy wether guilty or not, managed to get off scotch free. |

Any school administration staff can question a child without mirandizing them and it is admissable in court. Instruct your children that if they get into trouble at school and staff starts asking questions then they are to say nothing and demand that their parents be called. If the staff refuses then intruct your child to tell the staff that this is unlawful detention and they could go to jail for it.... |

Before you do anything sit down with your son and get the full facts. If your son was up to no good then be honest with yourself and hope your son leaned a lesson.
If you are sure about your son and he pleads innocent go down to the Police station and talk it over with the police.
If you are not satisfied after that complain to your local MP and Ombudsman. Be careful your son is not pulling the Wool.

Spunkwitch has given you the correct answer, as Code C of PACE 1984 clearly states. Obviously he is a Custody Sergeant and this is a bread and butter answer for him.
There are many occasions when juveniles are arrested and placed in cells prior to an appropriate adult being able to attend.
It makes sound sense that they are therefore searched before being placed in a cell (for their own safety). The law rightly allows this to happen. |
