He has never been convicted of any other felonies, he doesn't have much on his record except for misdameanor charges none on theft or anything to that nature and hasn't been in trouble in 2 and half years.. answers help...

The felony five is a relatively new level used mainly for drug abuse and theft charges. In Ohio, where I live and work, a felony 5 carries a max sentence of 1 year in prison.
With two counts of felony five, he is looking at a max of two years, but that is only if the charges are run back to back and the max sentence is imposed for each charge.
It would be impossible to second guess the actual sentence without any details of his priors and the items he was charged with in these two counts, but I would expect a realistic sentence of 6 months with up to 2 years parole.
Best advice would be to discuss this with your attorney and see if a deal can be made prior to court. Most felony fives are plea bargained out before trial.

It mainly all depends on what exactly he did. 3rd degree felony can have a minimum of 2 years jail time and a max of 10 years. 2nd degree felony is a minimum of 2 years and a max of 20 years. Lastly a first degree felony is a minimum of 5 years and a maximum of 99 years. Like i said, it all depends on what he did. All felonies can carry up to a 10,000 dollar fine. |

I'm afraid your justifications are not going to help him. It shows that he has a disregard for the law. It makes no difference that they were different crimes. Two and a half years is not long at all to go without commiting a crime. Depending on the state, he could get 5 years and about $5,000 in fines. |
