The prisons are overfilled and this may just be the only reason that your boyfriend will not be awarded a custodial sentence. Your boyfriend is totally irresponsible and he obviously has not learned from his first drink driving offence. What will it take for him to learn from his mistake - to cause the death of some innocent victim ? ? ? There will be no going back should this happen. He gets no sympathy from me I'm afraid. I've see, first hand the misery that drink drivers cause to families who have lost loved ones. Rant over. ! ! ! ! |

It's likely that he will go to prison for at least a month.
Why shouldn't he go to prison? The courts have got to get him off the road somehow for the sake of keeping other people safe. There's no excuse for drink-driving (twice!), causing an accident which may have traumatised other people, damaged their property or caused injuries and not having a licence or insurance which makes it really for anyone whose property he's damaged to get their costs paid.
His best chance for a low sentence is to plead guilty and sound really sorry. |

He should expect prison for at least 3 month, no liscence for a long time, and having to sit his test again. Maybe even counciling for his drink problem, |

Very doubtful that he will go to prison as they are overcrowded as it is. He will get a long ban and a fine.
But he needs to sort himself out and stop being so irresponsible, is he really worth you standing by him as Im sure you could do better |

Drunk, no licence, no insurance and a past record?? Sorry hunny, he is going to jail and I'm afraid to say deservedly so!!
One of my best friends lost both his parents in the space of a few years to drunk drivers, I think you need to get a boyfriend that can treat you and others with more respect. |

Depends what part of the court process this is. It sounds like maybe a prelim? Also this might be a felony depending how many other DUIs he has in the past. He obviously doesn't get it since this is not his first. It sounds like he didn't hurt anyone which is a good thing. Sounds like some jail time would probably do him some good. |

In the UK a second DR10 is usually good for a three year driving ban - however as he drives without a licence I assume he won't be much bothered about obeying that.
I think it unlikely (regrettably) that he will go to jail as, other than the DR10, the other offence codes (CD10, LC10, IN10) will normally incur points and fines.
Make sure that he is being prosecuted for Careless driving NOT reckless/ dangerous driving. reckless driving has a much greater penalty. |

You need to look up the minimum and maximums for where you live.
In most places a second DWI means manditory jail, fines and such. Then add in manditory alchohol awareness classes (costly) and manditory AA.
In most states and combination of three..... DWI, reckless or driving while suspended means they take you license for ten years. He has already hit that.
If just say this does not happen. He will no longer be able to get insurance. He will have to do the whole uninsured driver thing..... costly as well and certain conditions have to be met. Background check for most any job nowdays..... he is done. So you have to think longterm.
The no insurance thing is going to kill him in court. But.... things could be done. He has not been judged guilty for the current charges so he may be able to just pay for whatever if he has past fines. Then show in court w. his license. Maybe with the license (depending) and get insured. Show up in court with that. Take alchohol awareness before court. Start hitting AA. A lot of effort but at this point he is screwed.
All in all a couple of the charges have jail attached. How much is suspended is a crap shoot. Could be a year..... could be 5 months.
Basically he needs to do anything possible which include a really, really good lawyer. The cost without one (or a lousy one) will far exceed the cost down the road of not having one. |
