My boyfriend just got charged with possession of Cocaine for the purpose of Trafficking, is he going to jail ?

i live in winnipeg, manitoba, canada. he has been given a 9pm - 7am curfew. he must go to court on november 7th. they seized four scales from him. luckily he only had 2 grams of cocaine on him. can he go to jail for that? can anyone try and pridict whats going to happen. im clueless !?! he's 20 and has no other charges on his record... well he just has speeding/ red light camera tickets but i dont know if that means anything. the same night (saturday) he was also charged $557 for driving a uninsured car (his insurance payment bounced) & he got a ticket for oped alcohol, $195.... tho that wasnt his (he doesnt drink) can he fight that... he didnt even know it was in his car? anyone who knows anything about this kinda stuff i would appreciate some helpful answers. thanks.

First of all, he needs to get a good lawyer...call around, talk to several attorneys, tell them the situation and see what each one says about it. This is a pretty serious charge, but with a good lawyer it's very possible to just get probabation, house arrest, etc... especially because it's his first offense. all the other charges have nothing to do with this situation and will not effect the outcome of the case. They are all little misdeameanors. as far as the alcohol goes, it's not worth fighting...you'd have to pay a lawyer for that and you won't win. Also, if he is worried about gettiing prison time, he might want to admit himself into a drug rehab before his court date so that in court he can tell the judge that he voluntarily checked in to get help for coke (it would look good for him and the judge would be more likely to give him probation instead of a prison sentence) Well, good luck and hope I helped. see ya

You sure know how to pick 'em. He needs to be out of society and your life. With a good lawyer, he could get something light. But, he should get some kind of punishment, if he is guilty.

absolutely- possession with intent to distribute= prison sentence. scales are never a good thing to have either... speeding/ running red lights is bad too- shows a history of reckless behavior. and you are responsible for anyone and anything inside your car...

In the U.S.A., he would probably get some time, could be in the county jail and not prison. I know that where I live he surely spent some time away from you. If I were you I would think twice if you really want this person around you. Sometimes when caught doing something wrong, e.g. what just happened to him, if you are with him you can get drag right along with him. So think hard.

The best defense is for your friend to search his memory for the last person he gave a ride to in his car, and who sat where the drugs were found, and to bring that person to court to take responsibility for it's presence in the car. It should be presumed that your boyfriend doesn't give just anyone a lift, and that he doesn't give known drug users a lift, so narrowing the field of likely candidates should be a simple task. And if he goes to court without this answer, yes....looks like jail.

It sounds like he was arrested but released pending his court proceeding. Basically, a lot of different things could happen. The District Attorney could offer him a plea bargin that he could take or he could pleas not guilty and take the matter to trial. Get a good attorney and hope he can have evidence obtained excluded/suppressed or limited. He can even try to have the charges dropped for various reasons or negotiate a lesser charge in exchange for his role as an informant or a guilty plea in order to avoid a long and costly trial. If he goes to trisl good luck drug tafficking offenses have harsh sentences.

Sorry, honey - I think he's going to need a very good lawyer.

I don't know what the laws are like in Canada, but generally if you are caught with drugs and it looks like you sell them.... you will be going to jail. On the other hand, if you have a really good lawyer... maybe not. Since he has no priors he might get a very light sentence or none at all. Hope he has good luck and stays out of prison... but also away from the drugs. You need to help him to realize that is not a great direction!
