My daughter was hurt while in the santa clara jail,can she be compensated?

She fell from the top bunk and broke to facial bones, cut her eyelid open ,hit her head injured her neck falling face first on the cement?

Best and only advice would be to check with a good malpractice attorney. The attorney would have to prove malfeasance on the part of the jail in order for a lawsuit to be won.

No. Unless she can prove it was the fault of the deputies in some way. If she just fell (accident) on her own then she does not have a claim.

In addition to Don't break the law and end up in jail.


Seriously unless there was a design flaw or negligence then how is it the county's (taxpayers) fault. I am sure that many other people were able to use the bunk without injury. The factor that changed was your daughter, therefore her injuries are her responsibility.

She's already gotten her compensation. Doubtless the city or county picked up the medical tab, and she got a valuable lesson. What more could she ask for?
