ok this is a little complicated, but my sisters husband (my brother in law) well his nephews wife is my fiance's probation officer. she has been on probation for about 9 months now and her and my sister got into it and she has been threatening to turn her in for drinking but has no proof that she does. also they have my brother in laws sister which is her probation officers mother in law telling her stuff to try and get her put in jail but she lives 3 and a half hours away and she drove all the way down here to get the license plate number off MY truck so they could make sure it wasnt in her name. also she is like 5'2 and 89 pounds and has been most of her adult life and she has never even tried drugs but ever since her and my sister hasnt been getting along she has done 5 drug test in a row. the other night our neighbors asked me to ride with him to his old house to get some stuff, my fiance needed to go that way so i told her to ride with us. well her p/o's husband was in a store wew stopped at and i went in and bought 2 beers for me and my neighbor, when he got home he told her i was in the store buying two beers and she was with me. our neighbor is his cousin. but her p/o has been rude with her ever since her and my sister got into it. is there anyway she could get a new p/o? for being involved with the family? we live in texas and im not sure what the law is about that. any help is greatly appreciated

also her husband knew i went to jail about 2 weeks ago because he is a cop. and i think that is why he told her that because he never really liked me. and i think they are trying to get her put in jail because i went awol for family reasons and both of his brothers are former marines...

It sounds like you and your fiancee are not particularly law abiding people.
The probation officer's job is to get you to be a law abiding citizen again. |

Since your brother-in-law's nephew is your fiance's probation officer, I would contact the chief probation officer at the office where the probation officer works and say:
This poses a possible conflict of interest due to family ties. Would you assign her another probation officer?
Submit this in writing - and please check your spelling & grammar (appearance does impact the type / quality of the response you may get).
DO NOT WRITE anything else except to describe the relationship (your ex-brother-in-law's nephew). Having more details on too many issues just makes everything muddy.
I worked at Corrections for over 12 years. And state government for over 32 years. "Good sense" was to avoid anything that could appear to display favoritism / conflict of interest. |

Good grief.
Well, ideally, probation officers wouldn't be supervising people to whom they are related, but it sounds as if just about everybody in those parts are related to each other somehow.
If your fiancee is abiding by the terms of her probation she has nothing to worry about. Just because her PO doesn't like her doesn't mean she can successfully get her probation revoked without any evidence. On the other hand, if she isn't abiding by the terms of her probation, it is the PO's job to find that out. |
