My friend is on probation, and got arrested for Domestic Violence, is he definitely going to jail?

He went on probation for theft about 2 years ago, so this is the first instance of domestic violence. He got into a fight with his little brother, who is 18, and the parents called the police. Also, to add even more to the mix, he was drunk at the time, which is another violation of his probation.

I know that most people assume he will get jail time, but is there any hope he may not? Maybe he could be fined or have his probation extended?

Also, we live in the state of Arizona. It's hard to know exactly what will happen, but I'm just looking to see if there is any hope that he won't go to jail.

yes he will for the rest of his probation pluse 3 - 6 months more for each violation plus more time for the abuse

I don't see any way he will avoid jail if he is convicted of all charges.

Just the probation violation would be enough to send him to jail, add the domestic violence charge and his chances of staying out of jail drop to near zero.

If he is on good terms with his PO, maybe he doesn't get violated for this problem, if his lawyer can get him a deal (maybe bringing anger management counseling and moving away from the place his brother lives to the table) he might get a reduced charge. It's not likely that he will get a deal that does not land him in jail ... but it could happen!

My hope is that he will go to jail. He obviously has no plans to act like a decent person, so jail is where he belongs.

Well it all boils down to what he was on probation for.
Yes he is now looking at a probation violation. The very first rule of probation is...DO NOT VIOLATE ANY CRIMINAL STATUE OF ANY JURISDICTION...later on in the rules it goes on to state that he can not have any drugs or alcohol in his system. So he is screwed, he will be violated. In this county we have a violation arraignment where you are advised that a Petition to Revoke has been filed and they will advise him of what he is facing ( max and min penalties) they would then set him for a violation hearing where he has an opportunity to admit to violating. Then he will be set for a sentencing hearing. He will be re sentenced. This is where he could be facing jail time. If he gets jail time it will be for the violation, not the domestic itself. How many times has he violated probation? That will be considered at the time of sentencing. If he has been on probation for a felony charge(I'm guessing he is because he has been on probation for a term of 2 years) then he could possibly be facing time in the Dept. of Corrections.
