My friends just got arrested...?

And a friend of mine told me that when they turn 18 their crimes will be essentially forgiven and forgotten about or "whipped clean" as he says. I've always understood that this is not the case, and that these crimes will be constantly present on a police record, as well as information for colleges etc
Which one of us is correct?

I know someone with a juvenile record and he was told by the judge his juvie record would be sealed when he was 18.

So it no longer comes up as his criminal history when the police run background checks for warrants and stuff.

However several employers obtained the record from internet companies that store court reports from newspapers and other sources. I forgot the name of one of these internet sites that keeps showing employers his juvie record. He has gone back to the court to complain and they keep telling him the records are sealed. But when he went to one job interview and they asked if he had a criminal history, and he said no, they turned the computer laptop around and said "look at that" and his record was on the computer through this one internet company.

I will try to find out the name of the internet company doing it. To answer your question it is SUPPOSED to be sealed but in this day of internet data, people find it anyway.

your juvenile record is usually sealed unless they are viloent felonies. But when you apply for certian government of law enforcement jobs later on in life it will come back up because you need to be bondable and insurable.

Not what your friend told you thats for sure. They still have a juvenile record tracking. Over 18 is just the adult one

You are correct! The police always keeps your record. So when you go to apply for a job or college you might not get in.

It is partly true. The way it works is, when you are 18yrs old, you can apply to court to have a pardon given to you. They court will assess your application and look at how serious the crime was like if you had a fight with your dad and hit him and got 1yr assult causing harm and if it was not that serious than you will be given pardon. What that means is that only police officers at a higher level, not constables will be able to view the record and courts will be able to see the records. If you apply for a job or school, they will not be able to see it, even if you have a criminal check, it will not show.

But there are certain crimes for which you will not get pardon like murder, robbery, b & e, assult charges that caused a lot of damage to the victim. But it is up to the court to accept your pardon or no. But your record will always exist and at request will be given out to different organization like certain job industries etc.

Most states keep them on record but they are sealed. Meaning it takes a court order to use them against you. Which seldom happens.

They are in a file somewhere, but the file is closed up, only the cops can see it, but not anyone checking on it.

A youth crime will not effect you in the future if you don't apply for jobs that require more then the standard police security check.

Example: if you want to work at a casino they will require a general security check where it will not come up at all.

If you applied to become a police officer, you will have to address the issue during the application process.
