if she pleads the 5th amendment right can the state still prosecute me on these charges with out her as their witness.

Its not left up to the victims in domestic violence cases to decide whether the State prosecutes or not. Because in most cases, the victims are pressured to drop it. This way, they aren't held responsible.
As far as the 5th goes, it only protects her against self-incrimination. Doesn't protect you. |

5th amendment does not protect you. It only protects her against testifying against herself.
Unless there's something you're totally excluding,t his has nothing to do with your case. |

If there is enough evidence without her testimony, they can and will prosecute you. They will not need her to build the case. |

It is common for an abused person to 'change' their mind about pursuing charges in an assault and the state will pick up the complaint and pursue it anyway.
She can't plead the 5th.... she's a witness, not a suspect. If she refuses to cooperated or to testify, she'll be held in contempt.
You'll still get convicted.... with or without her testimony. |
