My husband got a ticket; cop claims he was speeding. But given the below factors, that's not possible!?

My husband owns a 1993 Ford Ranger. It's a 5-speed standard transmission and--as we say--doesn't go anywhere in a hurry.

Earlier today, my husband got a speeding ticket...the cop claimed he caught him on radar going 52 mph in a 40 mph zone. The problem is there is no way this is possible in this truck. My husband was at a red light first and was pulled over less than 1/4 mile down the road. The cop said he was speeding *after* the light turned green. My husband had *just* put it into 4th gear and had just made it up to 40 mph according to his speedometer when he noticed the cops lights in his rearview mirror.

How on earth can we go about proving this is a bogus ticket and that it's absolutely not possible for my husband to have been speeding?

Go to court. Plead not guilty then wait your turn to speak.

It says that the 1993 Ford Ranger is underpowered and has slow acceleration........

But at any rate.......(personal experience)

Fighting the court on a traffic ticket can be done by waiting until the officer is in court. When it is your time to give your explanation then request for the officer to provide his calibration sheets for the device used. He MUST have them available and up to date for these readings to be considered accurate. If he does not have them then your ticket is thrown out of court!

I was doing 40 in a 55 and got ticketed for doing 78 MPH. I won my case!

For those who say "Oh just eat it, it'll be cheaper" they're not considering that your car insurance will jump up...if you're not at fault then fight.

I would just pay the ticket. The judges hear the sames defenses week after week.Things that don't work 1. My car want go that fast. My speedometer said i was just going 40. 3. The officer didn't show me the radar reading. 4. There was another car beside me. 5. My motor choked down and was trying to keep my car running.
The facts are the police do this every day and are trained on the use of radar and court room testimony. He comes to this court every week and you are 1 in 3000 cases he has had to deal with.
He will be at court because its his job and he will be found in contempt and disciplined by his department if he is not in court with a good reason. If he has a reason not to be there the case will not be dismissed and continued for the next court date.
There are very few defenses to beating a radar speed case. One would be to hire and attorney. The attorney will file a motion for discovery. He will ask for the officers certification, he will ask for records that the officer checked the unit for calibration(every body does). He will check to the records of service, the last time the unit was check and certified by a proffessional, ( it will be the department keeps a list of all service dates). So in a nut shell you have 3 options 1.pay the ticket and forget about it 2. Take a plea or go to court and ask for a reduction. 3. Waste you time going to court defending yourself?Waste time and money if you hire an attorney and go to court and fight it.

Given that your truck isn't in pristine conditions, the speedometer might as well have a malfunction...but, either way, he might have been unlucky enough to find an overzealous cop in his way, you won't have a chance at proving otherwise, I'm affraid

take the judge for a ride. you should have asked the cop for a radar reading. ask when was the last time the radar gun was calibrated.

The first thing you need to understand is why they give speeding tickets, and all other tickets.

Tickets used to be a way to stop people from bad driving, then they learned to really jack the rates up and it is now a revenue source.

License suspension is now the way to try and stop bad drivers.

So, given this, you can go to court and plead not guilty. Make a video tape of the truck at the same place and show it cannot get going that fast in such a short time which will prove it to the judge and he will find you not guilty. maybe.

Yes, maybe, maybe he will say your husband was not stopped at the red light and find him guilty because he does not want to anger the cop and lose money.

Judges are elected and if they get on the bad side of the cops they could be in trouble next election.

SO, it really is complicated. THE VERY BEST OPTION?

See if he can get traffic school and pay a small amount and not have it on his record and accept the system for what it is.

Contest the ticket in court. Find a shop that specializes in your husbands truck type and get a trained professional to try and prove that facts you've stated. Good Luck.

if I got a ticket, I too would like to believe my vehicle is incapable of going whatever speed. However a quarter mile down the road is a pretty good distance, unless you live in the mountains and it was all uphill, even the worst dog of a ford ranger is capable of going 52 MPH within a quarter mile.

Have someone test the vehickcle.

If he was in 4th after a 1/4 mile, he should be doing at least 50!

In my Maxima, In 4th I am up around 100!

Just go to court on the date specified. Fourth gear at 40 miles an hour? No wonder you think the truck is weak, you have to wind third to at least fifty miles an hour to get full use of the engine. You may also want to have your speedometer calibrated, it just may be broken, but whatever go to court even if it is broken, most judges will cut you some slack just for showing up.

I guarantee you a 93 Ranger can go that fast. Maybe the speedo in the Ranger is off... A quarter mile is a fair distance to gather speed, and 52 is totally plausible. Figure that new cars are running top speed quarters of much, much more than that.

How can it be possible? For one the speedometer can be wrong. Dose the truck have the stock tires and gears? Over sized tires will give an incorrect reading as will different gears in the rear end. Its also possible that the officers radar was not calibrated correctly or not at all. When in court ask to see proof that the radar was checked and calibrated. And it is very possible to get to 52mph in only 1/4 mile.

in the end its the cops word against hubbies.

He could fight it, make a video of the truck accelerating flat out the same distance (400metres) to show that veh is not capable of acheiving claimed speed (it worked here in Australia when a lady got a ticket for 120k in an old Datsun...proved that car was not capable of that speed..and got off) But it will cost u $$ to prover your innocence. Most ppl just bend over....and pay the fine!

the ford ranger can get up to 80mph, your story is not believable

Stand up for what you think is right and go to court. Even if you lose you know did not cave in to the "system". Not all cops are geniuses and who knows he may not even show up at court and then you win.
Before you go to court bring the truck to a ford dealership and ask them to certify whether it's possible to hit that speed off a red light in approx 1/4 mile. Also take a dated picture at the stop light to prove that there are no "rubber burning marks"

Fight the ticket in court. Call the police dept and find out if the street you were ticketed on has been calibrated for Radar, if it has not you may win the ticket. Also if the cop doesn't show up you win by default

Here in Michigan, if you fight hte ticket the cop rarely ever shows up and you'll win the case and won't have to pay the ticket. It's quite glorious.

Dispute it. Go fill out the appropriate paper work at your local Police station. You can then sue I think ?

You need a credible witness that would testify that you were at a stop, at the light. Then you could build your case from there, but it would be difficult. Cops are bad people so you know he is going to lie in court to avoid having to admit he was wrong.
