My mom stoloe my identity. I tried to get the companies to remove the stuff from my credit but they won't without a police report. I'm only 19 and don't want my mom to go to jail because she's old and not in good health at all. Turning her in would only hurt me because she's helping me through college, and not turning her in would hurt me because I will have ruined credit for 10 years.
Should I just declare bankruptcy? If the police did come after her, what are the odds she would be imprisoned? She does have a past offense, she did the same thing to her sister, would they her in jail? Additional Details My mom is 57. She has parkinsons, manic depression, and is also disabled. It's easy to say "throw her in jail!" but I actually have a, you know, conscience. She ran up about $7000 in my name.

If some of the debts showing were incurred before your 18th birthday, you can at least have those removed. Contracts are not valid if one party is under 18 years old. The exception to this is court fines. Send letters to each of the creditors and CC: each of the credit bureaus telling them you dispute the charges, you were under 18 at the time and the account is not valid. Tell them you want all trace of the accounts removed from your credit file. You can also place a written statement on each of your reports explaining what happened, also state that any further credit issued must be accompanied by photo ID. |

She could go to jail. I don't think bankruptcy is a good idea. Call the companies you owe money to and work out a payment plan with them and pay them back. Check your credit report to make sure there are no more surprises and put a freeze on your credit so your mother can't do this to you anymore. |

Unless you file a police report, the credit companies don't have to remove the info from your credit report. If you want mommy to ruin your financial life for years to come, go ahead and file bankruptcy.
My ex-boyfriend's mom got her identity stolen by a former daughter in law. She filed the police report, the info got removed, and the credit companies sent the girl bills, but never had her arrested.
Your mother having a past offense (against your sister!) is a different story, though.

That's a pretty tough spot to be in, kiddo. It's obvious your mom needs to get some help, of SOME kind! Is this some kind of weird compulsion she has? Is she poor and needs the money? What's the situation? In any case she DOES professional need help. Tough love needs to work both ways sometimes. Talk to your aunt and see if you guys can come up with a private practice professional who can help her overcome this.
I know I couldn't call the police on my mother, no matter what the situation. I guess I would have to file bankruptcy, get her definite permanent help to stop, and go on with my life. |

Wow. I'm not quite sure how to approach this, but if she is an identity thief, she needs to be stopped. She has really messed things up for you and your aunt, and shouldn't be allowed to continue doing this. I don't know how she is helping you through college if she is destroying your credit history (as well as other identifiers).
Turn her in vs. not turn her in: Hmm...she's ruining your credit. She's setting you up, and now you have debt responsibilities that you are unable to pay. She "knows" you won't turn her in. What part of con artist don't you understand?
File whatever you need to file with the authorities. Call the card companies and tell them you want to close your cards to new activity. Contact the credit reporting agencies and make them aware that you have been a victim of fraud. |

your mom obviously does not have a conscience if she would do such a thing to you and her own sister. What's that 7000 dollars for? Did any of that come back to you, really? I'm sorry but you really should report her. 7000 now, could be 14000 later if you let this continue. She really seems to have major brain problems, so I'll put it this way, she may get a more lenient jail sentence, in jail she'll be looked after if she's got health problems, and more importantly, she'll probably get help to keep this from happening.
If this goes unchecked, and she does this to someone else, you may end up losing your mom to the prison system yet. |

She's not helping you in a healthy way by doing this to you.
Turning her in is the wise choice. If needed, they will give her medical care in jail. If you need to get a job to offset the help she's giving, get one.
I doubt they will give her jail time due to age, medical conditions, etc...
I do think it's also possible she might wish to be in jail. I knew a man dying of cancer who shot a bad-guy and turned himself in so he would be able to live out his years inside.
So many ways to look at it...
Stand up for yourself. She's not that long for this earth, whereas you, are just getting started with your life.

I don't quite follow your story . . . if she's helping you through college (I assume financially), why did she need to go to the extreme of stealing your identify for $7,000? If I were the companies you describe, I wouldn't believe you either . . . a claim of theft with no police report? Can't you return anything, where did the $7,000 go? Are you hoping to keep the $7,000 of stuff but just pay the $50 theft loss limit on your credit card? Also, none of the diseases you mention explain theft . . . well, maybe it was something she did in her manic phase?
Anyway, I'd think you'd be able to file a complaint and get a police record, and then as the victim ask that she not be prosecuted or get a very lite sentence like a fine due to her health . . you really need to ask someone who knows about your jurisdiction.
It also sounds like a family member needs to be ready to take over her finances in general, given her degree of illness (and tendency to steal). |

Why not report her? Do you have any idea how important your good credit is? Your Mom has ruined your name and if you ever want to take out a loan or simply apply for credit cards you won't be able to. It's going to take a long time to straighten things out as it is. If you declare bankruptcy, your credit is shot for the next 7 years. |

First of all let me say, I am so sorry your mom did that to you and her sister.
I would call your aunt and ask her for help in knowing how to handle it. But don't worry about your credit, because if it was before you were 18, depending on the state in which you live, you may not even be responsible for it.
Have you applied for credit anywhere and been turned down? If you have been turned down for credit you can write the credit bureaus and prove who you are and your age and they have 30 days to resolve it, then it has to be removed. But what you need to do is write to the credit bureaus with proof of who you are and a copy of the credit report and they will have to remove it. You will need to have proof of your credit report and I.D. to have them remove it.
I would also call the Social Security Administration and tell them your identity was stolen, they don't need to know by who, just a copy of your credit report, and ask if you can get the process started to get a new SSN. I don't know how complicated it is to do though. I do know you will need two forms of identification to do it. Ask your mom for a copy of your birth certificate, and I am guessing you have a drivers license and of course your social security card. The SS Admin is probably a long shot, but what have you got to lose at this point? Good Luck! |

I know you love your mom, but this is unhealthy. Report her, so she can get counseling and other help. You are only enabling her to repeat her actions when you don't report her. It will be very hard for you, but it dosn't sound like it was very hard for her to hurt you. You are doing the right thing. |

Your credit will only be ruined for 7 years, and anyway I must ask: Are you Asian? This is odd if your mom has done this. You can resort to a civil suit, in which case your mom will not have to spend jail time and is still obligated to pay you back. |
