my neighbour who lives in the flat upstairs from mine shouts at her dog, and plays loud dance music at anytime of the day or night. i know she takes antphetamines when her mates are there and she smokes cannibis when her abusive boyfriend is round. when people have knocked on her door asking her to turn the music down she says ok and turns it down for a minute then turns it on louder. its always the same songs which makes it even more annoying. i used to work in a night club and its like being in the wash room behing the bar its so loud.
ive been complaining to the local council since feb but they have done nothing but wrote her letters to say they have had complaints.
how would i go about getting an asbo put on her? im sick of this.

Keep the pressure on the authorities to do something! You have the right to peace in your own home. Or you could go up and complain to her and if she hits you, then you can sue for abuse then get an asbo on her! |

what she is doing is actually causing a disturbance and I have had neighbours like her in the past. What I did was just what you have done, knocked and asked them to turn the music down etc...next time just phone the police. You are perfectly justified to because you have asked her on a number of occassions to quieten down and she ignores you. With any luck they will turn up and shock her and they may even find drugs on her. Have you complained to your landlord coz they should evict her |

Put formal complaint into Council again (this time in writing - keep copy). You also have a right to issue proceedings in the County Court yourself under the Control of Pollution Act from and add an application for an injunction to your plaint. If you are granted such injunction by the Court and she breaches it again - she could be arrested and 'banged up in the nick'. |

I know this problem all too well!!! The thing is, the neighbour probably wouldn't give 2 hoots about an asbo and would carry on as normal. My advice is as follows - you need to carry out an 'all out assault':
* Get all your neighbours involved to do the same as below
* Complete your noise diary as suggested - the council will put you on their list and everytime you hear the music, ring the council, they will keep sending someone around until they catch them in the act
* Complain to every department in the council you can think of and keep copies e.g. environmental health, tenancies & estate management, anti-social behaviour team
* If she is allowing her dog to poo in any communal areas, complain about that as well and if you can get a photo of the dog pooing, even better!
* If you are a council tenant, ask to be moved - if she is a council tenant, ask for her to be moved
* Go to all your council forums / meetings and complain
* Complain to your local (political) councillor
* Go to your doctor and tell them that you are stressed out and not getting enough sleep, labour the point and ask them to write to council or give you medical certificate to take to council
* Complain to RSPCA re dog
* Complain to Crimestoppers re drug dealing
* Complain to your local police community liaison officer so they can do drive-bys and monitor the situation
* Phone the police every time the most minor thing they do gets on your nerves
* Every time she turns her music back up again, go and knock again and again and again
* If there are children involved - report them to social services
* Shop them to anyone you can think of e.g. benefit fraud etc.
* You can complete an ASBO log, but you have to still ring the police and the council every time there is an incident to get reference numbers.
I have been doing this to my neighbour and she has just about got the message - but it has taken about 2 years.

Keep on at the council, and their environmental health department. Insist they come round and take sound samples / install microphones etc. Also, contact your local Police on their non-emergency number and ask to speak to an ASBO officer for your area. Whilst they have no power to deal with noise as such, they can liaise with the council in the issuing of an ASBO. However, it may need more than just yourself to get one sorted out. They do take time to process, and many statements from likeminded people to yourself would need to be taken, to prove that this person is a real problem. Is this person renting their flat? If so, speak to their landlord/landlady and see if they can assist you at all. Don't give up - keep at it - it may take some time, but it'll be worth it in the end. Failing that (and before you say it - I know you shouldn't have to), move home. Hope this helps. |

I would keep contacting the police and council. If they are sending the letters then they are aware of the problem and you have evidence that you have contacted them. Stay on them eventually they will get tired and do something. Remember the squeaking wheel gets the oil. |

call the local police station anonymously, and tell them there is alot of activity in the flat and you know for sure that drugs are involved. They will be around like a shot. Is it a council flat? It is quite hard to evict people. |

I do not know where you live or if you own where you live. It makes a lot of difference. If you rent, the manager can definitely do something as could the owners. It sounds like the police aren't doing there job as she is defintely violating laws concerning noise levels even for the daytime. The drugs are the main problem I think because they make her unconcerned about others. The evil ones says get back at her some how but the Lord says do what you can with the laws she's broken and against all better judgement, treat her kindly and let Gods turn her around.

You need to keep a noise diary detailing dates, times, length of time the noise went on for, type of noise, steps taken and what happened. Do this for about 2 weeks. Once you have your diary go to the council with it and demand something is done. If any of your neighbours are disturbed by this noise then they should do the same. I would suggest that the department you talk to in the council is the environmental health department. If they still can't do anything about it then talk to someone in your local police station and show them the diary. Remember to keep the diary going while you are talking to all these people. The first thing the police and council ask is have you kept a diary.
The other thing to do is maybe contact the RSPCA and report suspected animal abuse.

go to citizens advice and contact environmental health. they can confiscate her sound equipment. also contact your landlord. he has a responsibility towards you on this too. citizen's advice will tell you exactly whta your rights are. |

my son lived opposite a drug dealer. He suffered people coming and going at all hours of the night and day, arguments over the quality of the gear he was selling, fights with non-payers etc etc. He complained to the Housing Association who did NOTHING, in fact they placed him in the flat knowing this swine had operated in a similar way for the past 10 years and they didn't even tell my son so that he could make an informed choice about wether to move in or not! He had a daughter of 18 months when he moved in and because of all the noise, stench of crack burning and shouting etc my grand daughter is frightened of any sounds at night. The HA told him that he would have to testify in court about this person and then they couldn't guarantee getting him out. The Police were powerless because he would hide his gear so that they never caught him with any in the flat or on him. Eventually my son agreed to keep a record of all the movements in and out of his flat and slowly they built up enough evidence to serve a drug house closure on him. The Police also provided my son with a panic button which went straight through to the Police when he frequently tried to kick his door down.
My son served the HA with a counter claim for his rent because he was unable to live there in peace of free from fear but you know what? There is no law which says that your Landlord has the responsibility to protect you from any of his other tenants!
We are now campaigning to change this law in cases where tenants are eventually evicted because of the behaviour, drugs, noise etc. and where it can be shown that the Council or HA have not done enough to help the victims of the behaviour.
My son won a Good Citizens Award for his help with the Police and the HA got him out for nothing.
He refused to pay his rent because of all the hell he was put through and they took him to court and tried very hard to evict him!

If you go to Environmental Health you have to keep records for X amount of time they then take the person to court and have them bound over to keep the peace, only when they break this order can they then take action. When these people are taken to court they always seem to have a social worker or someone pleading their case that they are an addict or unwell and if they were evicted it would cause them psychological damage.
This happened 3 times with the drug dealer and the judge took pity on him because he had a rough life. The law does not like to put people out on the street and unless this woman has not paid her rent there is little the Council can do. Notice that money comes before anyone's peace of mind!
The landlord does not have to rehouse you or do anymore than write a few letters or go round and speak to them, if they do not want to.
My son wrote to his local MP, Environmental Health, Health & Saftey executive, got Dr's letters, letters from his manager at work etc etc. Still nothing. Contact your local Police and start keeping a log. If you suspect that she is selling amphetamines tell the Police. Drug dealers can be evicted even without a conviction, the court only has to have a suspicion supported by general evidence i.e. records kept by nieghbours, equipment (needles etc) found nearby known users visiting reguarly etc, that drug dealing has been going on to get a Drug House Closure order.

Contact your local Environmental Health dept...they will send someone round to monitor the noise level..you will need to do this before any asbo or such can be issued..good luck |

Document all your dealings with the council and keep that as a record to fall back on if they fail to act.
If you haven't already done so keep a diary of every breach caused by your neighbour. Call the council or police every time as well. Sooner or later they will act as they become tired of having to come round to your flat. |

The local council MUST do something. If necessary, go down there. You need to speak to housing and the environmental health officers. Some councils have nuisance neighbour teams - get them involved too. Keep a diary of all incidents of noise - times and dates etc. And any suspicious comings and goings.
Get in touch with your local police and ask if they have a local neighbourhood beat bobby. Get in touch with them and explain the problems. Ask them to help put pressure on the council,
If you can be SURE there are drugs, also tell the police this and the reasons you have. Hopefully if she is succesfully arrested for an offence, this will give you more power and also the council.
You will probably not get an ASBO but who the hell are your council - they are obviously useless!!!!
