My roommate smokes pot, does shrooms and takes acid. He usually has something in the house, especially weed. I don't do any drugs but I certainly know about his use. I am a student in Florida and I was wondering if he gets caught will I get into trouble, too? The main reason I'm asking is that it's time to either resign our lease and move on, and I'm not sure I want to risk getting into trouble for another year. Thanks!

You could be arrested.
There is a legal principle called "constructive possession". If there is something illegal in an area you have control over, and you know it is there, it can be legally considered yours.
You would have an argument if you had separate bedrooms, and the drugs were found there, but if they are found in a common area, they are legally yours. |

Yes it is possible.
Legally and criminally it is very possible that your roomie could try to blame everything on you should he be caught.
Civilly, many leases (via "crime free" addendums) allow landlords to evict any tenants that are either arrested, cited or have a certain number of police contacts. |

I'm not sure you'd get in trouble if you alerted the authorities.
If you help in an investigation with him you might possibly get a lsser sentence or no charge at all.
I would try to stop the drug use if possible. Get him to stop or you could be charged with "embedding" or assisting a criminal. That's only if an investigation from the police believes that so. |
