My son who is 25 got into a fight with a 19 year old gay guy. My son isn't gay.?

They were both living in the same house with this older man. The fight got pretty loud and the neighbors called the police. The gay kid got into my son's face and started the fight. This was in my son's room. The gay guy started going crazy and my son pushed him out. The guy came back with a meat cleaver and my son got it away from him and threw it into another room. My son went back to his room to clean up a mess that was made during the struggle and that's when the cops showed up and pointed a flashlight in my son's face. my son had a broom in his hand and the cops thought he was going to hit them with it. The cops started to hand cuff my son and he said why are you doing this? He was just defending himself. They cuffed him and took him to jail. The gay guy said that my son started the whole thing and then added to say that he tried to rape him and tied him up also.They believed his side. My son had a $50,000 bond and a bunch of false charges against him. The bail amount was$5,000. I didn't have the money to bail him out. Today one of his close friends bailed him out and came up with the $5,000. If my son is found innocent of all these charges,is his friend out the $5,000? To which my son now owes the money to. I think he should have stayed in jail and not be bailed out. After all he was innocent! I need some answers...................

You should never be in jail if your innocent. Jail is not a good place concerned mother. I don't care how old your son is. Jail is not a good place.

Bail goes like this.

The person who bailed him out will get there money back after the case is over with, and court fees and costs have been deducted from it. So not the full $5000, but some.

If you would have used a bail bond, you would have owed the bond company more than you actually used to bail him out, and wouldn't get any of it back.

If he is found innocent then yes the bail amount will be refunded. Him staying in jail has a down and upside. The downside is he is in jail, and no matter what the law says it is pretty hard to convince a judge you are innocent when it is his word against this gay guys when he is the one in handcuffs. However if money is an issue and upon being bailed out he will be defended by a public defender than the bail money would serve a better as a payment to a legitimate criminal defense attorney who wiil actually fight for your sons case.

Also, all of the above posters are wrong. The $5000 was the fee that the bonding company charged to post the $50000 bond. Guilty or innocent, that money is gone.

I am a bondsman in Arkansas. He will not receive any of the 5000.00 back. If he had but up the entire 50,000.00 bail, then he would have received the 50,000.00 back minus court cost and fines.
