ok so i was getting off the 60 on rural n there was a red light, i turned right n there he was wit his lights on, pulled me over n then when i asked him why did u pull me over for, he said cuz i made a right turn on a red light when there was 3 signs that say NO TURN ON RED lol, i make him show me the signs cuz i didnt see any of them at all lol...well i try to reason wit him n be nice so i can get away wit a warning, bt he's like i dont give favoratism to any1 so here's ur ticket lol, how messed up...well anyway, i was looking at the ticket and on the ticket the officer put down that i was going 5mph n the speed limit is 55mph on rural lol the thing is i came to a complete stop on the red light, i even waited till all the cars passed n i made a safe right turn, which means i wasnt going 5mph, can the judge just throw away the ticket cuz of that? or cuz the actual speed limit is 40mph n he wrote it down incorrect? oh yea once more thing, the court im supposed to go to is in chandler which im assuming that he's wit chandler police, bt isnt rural n the 60 in tempe already? If its tempe, can he give me a ticket? hopefully some1 helps me out wit this cuz i really dont wanna go to traffic school lol or pay the ticket n take 2 points on my license

if their were no right turn on red signs then those you will have to pay , even if you didnt notice them unless they were obscured by something , tree limbs etc. then with photographic proof of this you may win and not have to pay . now the speeding , i am unsure of , i believe if the ticket is not written correctly the charges may be dropped for it but i dont know for certain . contact a local attorney , most will give you a free consult and see what he/she says. |

First things first, In traffic court, the cop can say anything he wants to and the judge will rule in the favor of the officer.
In your case, the speed on the ticket has no meaning, it is just written down so that all of the facts are recorded. It does not say you were doing 60 or 65, it states you were doing 5mph which is just a fact of the incident. I have been to traffic court about 70+ times in my life already and the reality is: you will NOT beat this ticket. There were posted signs, the office observed your turn on red. It ends there. Unless the signs were placed in such a way that they were covered by graffiti, covered by a tree branch/bush, or the sign was worn and impossible to read, there is no way to fight it legally.
In court, the only thing that matters is the facts. You CAN get this ticket dropped to a lesser charge without a doubt. There is a catch though. Most states will allow you to plead guilty to a charge of unsafe driving (which is no points) but you have to pay a higher fine. This is the best choice because if you decide to take the ticket as is, you will get point, your insurance cost will increase and you may have surcharges which can be as high as $200 per year until the points leave your record. Go to court, plead not guilty and talk to the prosecutor or directly to the judge or judge like body in your local court and ask to have this charge reduced to a lower charge.
Everyone makes a mistake sometime and it's hard to observe every single thing but you got nailed and the cop wanted to write you. Pay the higher fine and you'll be set. |
