just tonight i was involved in a hit and run i was traveling a highway
feeder road and a car leaving a side road to my left getting ready to
merger onto the same road as me Failed to yield or stop i cant
remember what type of sign was there but he didn't stop at all and i
slam ed on my brakes and swerved to avoid him but couldn't and ran
into side of his car with that said since he ran a stop or yield sign and
i the victim or am i at fault i stop-ed at the parking lot just like a few
feet from where it happen and waited the driver who hit me took off and
i haven't seen him again and i didn't call police cause i didn't have a
car make or possible plate number or anything all i know is a dark
colored car so what should i do from here i plan on telling Geico in the
morning but should i be ok or do i face chance of arrest thanks to everyone

ALSO: i called my Girl friend who works like 5 mins up the road where i was leaving from when it happen and she said theres a Yield sign for the traffic leaving the side road to yield to me and the car didnt stop and hit me

Its not a requirement to file a police report. If you believe you were the victim of a crime, you can but its your right not to. BTW, if you did want to, not having a plate number shouldn't prevent you from calling the police. They'll just handle it as "cold paper" (unsolvable).
Also, Its not a requirement to notify your insurance company.
If the other driver did get a plate or good description and alleges hit and run, you might have a problem but it doesn't sound like that. |

Go down to the police station and file a police report. Call your insurance carrier, too.
There is no harm in filing a police report. The other driver might be doing that right now, or will in this week. If a dispure arises, it reflects very well on you that you filed a police report.
The advice below from SPP is totally incorrect and risky. Even if you admit fault in a police report, the police report is inadmissible in a civil suit. |

You hit the other person, they ran...? you got off easy...
Unless you could prove there was a sign there (and since you don't know what it said, and have already admitted that, give up), and that it gave you the right of way, then you are at fault.
You are expected to maintain a safe distance from all vehicles and drive at a safe speed so that you can safely brake if someone does something stupid.
You should probably NOT call your insurance company, and just fix it yourself... unless there is a lot of damage to your vehicle... and its worth admitting you had an accident/having your rates go up.
Pay it, consider yourself lucky for being alive, wear a seat belt.
ADDED later- There is nothing wrong with filing a plice report, that's probably a good idea, but again, no need to contact the insurance company because it was your fault...
Because you don't know what the sign said, you have no idea whether or not you had the right of way (which means you were being negligent)... and then you could not control your vehicle and as a result, you hit someone else's vehicle... that is your fault unless, by some chance, you can prove there was a sign that gave you right of way... but in reality, you don't remeber what the sign said.
