Ok well i figured i need to word this alot more better than my old question i posted.

But my brother who is 23-years-old Got his license back the beggining of march because it was suspended for a few years. We have took the proper steps to try to get his license put on hold because his mental condition he is known trying to kill himself because sometimes he hear voices so we contacted DMV and talked to the supervisor and she said she would look into it but nothing was done. Then we sent them a doctors note nothing was done and he continued to drive until on March 19th 2009 he got in a back accident and still in the hospital fighting for his life but doctors said he has a good chance in beating the odds. He was going 79-81 mph in a 25 mph zone because it was a beach line a very long road and that area is known for speeding but they still didnt correct it by putting more stop lights. But he crashed head on and the other person got hurt and needed surgery and we understand it is my brothers 110% fault and he is responsible but we felt like DMV could of did more. Now the PD served papers today and they going to file charges on him for wreckless driving and violating the speed limit which we will have to get him a attorney if he pulls threw to fight it. I am not taking up for my brother or trying to blame others because it is his fault but DMV could of did more what do think? is it worth suing them? And for wreckless driving how much time could my brother face? they have it down as 2cd degree. the other charge is a misdemeanor. He also is on probation for a year but we already talked to his PO to try and get something worked out shes nice and understanding.

I do not know what state you are in, but unless you had your brother declared mentally incompetent and the guardian went to the DMV, generally there is nothing that they can do.

Understand that for all they know, the person going to the DMV could be angry at your brother and are trying to get back at him. The DMV needed a court to order the suspension.

Here are some things that you as a family could have done. Take his car keys (and car for that matter) so that he cannot drive. If he is a danger to himself, go to the courts and have him declared so. Before you do that, talk to an attorney so that you know ALL of the implications and repercussions.

I am sorry that your family is going thru this trial right now. I hope your brother and the other person are ok.

you are going about this all wrong you need to get a doctor to deem him too dangerous to drive and have then submit something to the dmv
reckless driving charges always cause a lose of license
