New NJ driving decals for people under 21?

I just read an article about drivers under 21 being forced to have stickers on their car because some kid died three years ago when she was in a car breaking that passenger limit for teens... one thing wrong with this. The limits for drivers are only for drivers under the age of 18. I simply refuse to put that thing on.
Do they mean people just getting their license?

For people not familiar with new jersey laws, drivers under 18 can't driver past 12 (now they want it to be past 11), they cant have more than one person in the car either.

I CANT put that sticker on my car. I will get pulled over from coming home at like 1 am, or having my friends in the car. What the hell? Why should I have to wear it if the law is only for drivers under 18. A lawyer in our state is suing to get rid of this.

I AM 19 going on 20! I don't want to waste my time getting pulled over for a law that has nothing to do with me! If they are going to put those decals on cars make it for people actually being effected by the law!!

They want to make the stickers velcro. I'm just not going to put them on the car. There is no point for me to have that sticker on my car. I'm not under eighteen.

States are generally free to enact their own specific laws provided they don't go beyond what's mandated by federal law. In other words, their law can be less than federal law but not greater, generally in regard to penalties.

You may want to check your state's motor vehicle code to see what/if/who actually implemented the law you're referring to. It sounds somewhat discriminatory to me, although courts are more inclined to not care as much about this issue when it comes to juveniles. You might also want to review any state or federal precedents regarding these types of laws for your as well as other states.

If you can find cases where this law has been overturned or ruled discriminatory, you may be able to use that as a basis for your own argument. Since states also receive federal money for various highway and traffic related matters, if you can determine the law is discriminatory, this could be something you could use as a basis for added pressure to repeal the law in your state.

Another avenue might be to consider a class action suit. Try checking with the attorney who's fighting the law in your state on that.

Short of any of these remedies, you'll have to decide if not abiding by the law is worth the penalty you'll get if caught, which in addition to fines, may include loss of your driving privilege for repeated offenses.

Since every state considers driving to be a privilege and not a right, you're probably in for a fight.

P.S. I'm not a lawyer or familiar with NJ law, but if your state considers 18 the legal age of majority (for voting, entering into legal contracts, etc.), I'd say they'd have a hard time supporting their position on a law such as this.

THE GOOD.....unfortunately driving is a privilege and not a right. So with that said...either follow the rules and put the sticker on.Wait until your 21 and throw the decals in the garbage.
THE BAD.... Or don't follow the rules and higher your chances of receiving extra fines or restrictions. What you said is exactly why some bozo made up this law...to prevent future teen fatal accidents . I work in hospital security and i have seen plenty of fatal under 21 car accident victims. And guess what..about half of them involved multiple teenage passengers.15-19years
THE UGLY.....the decals will make it easy for child molesters and pedophiles to target teenagers. Also who will stop people from stealing the decals from the plates??what can you say.. IM SORRY officer but my decal was stolen??

The law is for drivers under 21, not under 18. If you don't like it, move out of the state. I think it's a great law.

If you don't want to get pulled over, don't have all your friends in the car and don't go home so late, problem solved. Stop being dramatic.

imo, it is an unequal application of the law and probably unconstitutional.
of course, so are those restrictions for drivers under age 18.

besides -- what do they propose to do about cars owned by adults that are sometimes driven by their 20 year old??

You will not have to put that on your car! Don't sweat it. The law actually is for provisional drivers only. Espesially under the age of 21. But mostly under 18. If you don't have any provisions on your licence now you will not have to use that sticker a year from now.
