Should we say "no comments" for all the questions by the Police?

depends what you have done, if you haven't done anything, i would say as much as i can to clear my name, good luck, hope that helps.

Hi Beckham,

You can say that if you wish but a jury can make inferences from the fact you did not answer questions or offer an explanation. In other words they can assume the reason you did not answer questions because you were guilty and the conviction would be safe.

Ian UK
You have a right to say nothing about an allegation but this can be detrimental.

At the end of the day, if you've done it you would look a lot better if you are big enough to admit that you've done it and would be a lot better thought of. If you say 'no comment', you might as well be saying 'I'm guilty'.

In my experience, lots of solicitors advise their clients to go 'no comment' as a way of trying to wriggle out of it. Solicitors don't always give the best advice.

vdv_desantnik
dont even say that, dont say a single word

Presuming you're in the UK, LISTEN to the caution you're given, it tells you exactly.

If you're not cautioned, it would be because the police don't have any reason to believe you may be charged for an offence - in that case why not answer?

Ummm.... my solicitor exorcises my right to remain silent

That depends on what you have got to hide.

1) Why would an innocent person decline to protest their innocence when questioned?

2) The "Caution" in the UK says, "you do not have to say anything BUT IT MAY HARM YOUR DEFENCE IF YOU FAIL TO MENTION WHEN QUESTIONED SOMETHING YOU LATER RELY ON IN COURT........" That being the case keep silent and your defence could easily be shot down in Court.

No comment that's your right I cant see how it can harm your defence by not saying nothing "oh right then you must be guilty because you didn't say a word" let them assume what they want ! who cares at least if you stay quiet you cant make prosuecutors questions easy for them to twist it all about So exercise you right at least you got time to think And you cant take back what you say can you

depends on the officer

You can, you can also be thrown in jail for committing a crime which you seem to have no explanation for.

Bear
I assume we are talking about questions in an interview following arrest? If so then it is a matter for you to decide whether you should 'no comment' or not. Unless you feel compelled by the advice of a solicitor. The interview is your opportunity to explain yourself, your actions, any defences or give any alibis. If you choose not to do this, which is your right, then it may harm your defence in court. The magistrates may draw an inference from your silence. If the case goes to Crown Court the jurors are even more likely to believe you are guilty, because surely an innocent person would want to explain themselves.

Before, or after you're arrested?. Hope they don't say the same to you when you ask if you can make a phone call.

Depends on what's going on, if you are being questioned by them because you are a suspect.. you have the right to remain silent, however if you are a witness and you withhold evidence... then you will probably be arrested for obstructing.

Follow it with Sir.

Only if you first understand why you have that right. It is givenm to you when cautioned prior to being questions.
The reason for the caution is so you do not have to self-implicate in an offence.
this means that if you chose not the give an answer or 'go no comment' the investigating officer and the courts have the right to assume your guilt and dishonesty for that question.
try actually reading the caution and understanding it

"you do not have to say anything"
obviously you dont have to answer any questions

"but it may harm your defense if you do not mentions when questioned, something you may later rely on in court"
the court may assume your dishonesty

"anything you do say may be given in evidence"
self explanitory

Argue with a tree
it really depends on the situation. if you're guilty ... then yeah you may want to keep quiet until you have a lawyer present, but dont say "no comment" just say, "sir...(ma'am)...I'm not going to answer any questions until i have a lawyer present" or you could simply say "i plead the fifth" but that sounds a but weird if you ask me.
