our court date is in a like a little over a week but they are keeping him in jail on a $5000 bond. If he gets out on bond he will be on house arrest with protection order and he can't talk to me. I did not order the protection order I told the police I did not want one. What can I do now to get him out of jail with no protection order before the court date? I feel like the police took everything out of context and I want to know me rights.

Sounds like your mother is trying to protect you. Sometimes when you are in an abusive relationship, you don't make wise choices. You sound just like other women who try to protect their abusers. If he is innocent, it will come out in court. |

It's not the Police doing this to you or your boyfriend; it's the District Attorney's office. There's plenty of cases where women get beat just short of death. The women are so scared of the guy, that they refuse to press charges. So now, a lot of States and counties have adopted a policy that allows them to follow through with full prosecution and full protection of the victim, even if the victim says no. It's actually one of the best things that ever happened.
I suggest you let the court system handle it now. The D.A. will know if it was blown out of context and will drop the charges if it was. |

In several states, the police will arrest the primary aggressor and take out a protection order on the defendant in domestic violence assaults - whether the victim wants it or not. The reasoning behind this is that before the laws changed, many women were getting killed after the police left the call of a domestic dispute. You can not bail him out of jail. On his court date, you can go to court and request the case and the protection order be dropped. There is nothing you can do until then. Nothing. |

Tell the judge, when you go to court, that you do not want a protection order and ask that he/she lift it. |
