Ok my boyfriend is on probation, got a dui, got weekends in jail, got another dui, how long is he looking at?

I think it depends on the jurisdiction. He will probably serve jail time, depending on the judge maybe 90 days, could be more for the original term of probation that he violated. Then, he will probably be sentenced to probation again. This term will be longer, he will have to do more intensive treatment and education. His Driver's license will be suspended and he will most likely be required to apply for an occupational driver's license and get an interlock or an ankle alcohol monitoring device like SCRAM.

If he does it again after that, he goes to state prison for felony DWI.

It is quite possible they will revoke his probation and send him back to jail for his original sentence, and that is just for the first DUI. He will still have to answer for the second one.

Your boyfriend either has no respect for the laws or he just plain thinks it's all a joke therefore he should be thought that it is important to abide by the rule of law by serving the maximum sentence for his transgression.

My grandfather was killed by a drunk driver. I don't mean to offend you, but whatever sentence he gets, he will deserve. That's a serious thing, and it should not be taken lightly, if he's stupid enough to do it twice, he belongs in prison.

Well...hopefully for the sake of the rest of us...a LONG time. There is nothing I can't tolerate more than a drunk driver! I have children, and I hate the fact that these idiots are on the road coming towards us in the other lane at night. If your boyfriend is on his 2nd DUI, then obviously he learned nothing from the first. The judge will definitely see that and take it into consideration. I am SURE this time around it will be much more severe for that reason...as it should be. I would say a year at least.

During good economic times the judge would max him out. He would be looking at 10 years. However, due to the financial crisis, many states are letting prisoners parole early and otherwise are trying to put offenders into alternative corrections programs.

He may get lucky or he may spend the next decade in prison. Two DUIs while on probation are like slapping the judge in the face . . . don't expect mercy. Just hope the state is short of money to hold him.

Well I hope the judge throws the book at him and makes him serves his sentences consecutively and not concurrently. But he could be looking at a few years in prison.

All depends on the original charge that got him on probation. Because the probation will now be revoked for sure unless the judge is his uncle. Compared to South Florida, he has already gotten Really lucky. The First dui on probation is usually a deal breaker.

They gave him a chance and he spit on them. For the sake of your community, I hope it is quite a while before he is allowed back out among them.

Hi, my boyfriend was given atr, because we got into a arugment, I was upset and called police on him twice. He has never beat me up or anything but has threating me and when I called police that's what I told them. They told me they couldn't do anything because he has not comitted a crime, then there was another time when I was drunk and called police because we got in to an arugument, this time he received a disorderly conduct and he reported it to his po. His po was pissed and took him into custody.She asked me to come and give a statment and I did, and then she requested the police reports which didn't saying anything but that he threatned me. She has now given him a alternative to revocation to complete a 90 program. I wanted to know what are the chances of him doing a program outside of jail or will they make him do it inside of jail and make him wait until a bed becomes avaiable. Someone please give me some answers.
