I was arrested with four ounces of Marijuana, the way they arrested me is questionable. I was offered a good price by a regular dealer i knew, kind of out of the blue, but it seemed legitimate. I decided it was a good enough deal to go get the money and buy it. Turns out the dealer was previously arrested and working with Narcotics of West Alabama and he set me up when i went to go buy it. My lawyer doesnt seem to see the problem that i see. The NWATF PROVIDED the drugs after SOLICITING them to me with an informant, then arrested me right after i purchased it. I realize this is not Entrapment because i knew the drugs were in fact illegal, but i want to know how they can get away with this, and why my entire future is now jeopardized because of these officers

You seem to have been caught by a fairly routine drug buy bust. It is not entrapment because no authority ever caused you to commit a crime of their own contrivance while acting under the color of law. Though I disagree with marijuana prohibition, it is hard to deny that the officers acted both routinely and legally. LEO's of various types are afforded great authority to possess, supply, or even use controlled substances for law enforcement purposes.
On a related matter, you say you were in Alabama at the time of the incident, but even with Alabama's insanely harsh drug laws posession of under 2.2lbs is a class A misdemeanor. Though a class A misdemeanor is a serious criminal charge that leaves you subject to having a permanent criminal record, it is much less severe than a felony. |
