my fiance was granted parole in early January with the stipulation that he complete 3 months at a minimum facility (he is currently in a medium). It has been over 2 months and they still haven't moved him due to beds not being available at the minimum he was assigned to. My question is, will the 2 + months he has already completed be considered? If so, that would mean he could be released in April . If not, that means he is doing an additional 3 months on top of what he has already served which is not fair .
The overcrowding isn't his fault. He's been a model prisoner - no tickets. Plus this was his first offense, drug dealing.

Yes, he will be credited with the time served. The Dept. Of Corrections in most States are over crowded. Especially minimum security facilities. If there is any doubt on his part, he can speak to somebody in the records dept. where he is currently doing his time. |

Yes, it is quite possible he will get credit for time served after the offer was approved. |
