Police brutality by K 9? and how about miranda rights if collared by K9?

K9s are considered a tool as is any other use of force option like pepper spray, tazer, baton or firearm. They have their place on the use of force continuum. It is not Police brutatlity if they are used in accordance with the continuum. While I am not American, here, there is alot of case law, both criminal and civil, dictating the situations the K9s are acceptable or not
As other has mentioned, there is a warning used prior to sending the dog.
In some places, K9s are even taught what is called "bark and hold". Meaning if you stop running and stand still, they will not bite. they will bark at you until you are either arrested by the officer or you decide to run and the apprehend you.
As for Miranda right, how is being apphrended by a dog different than by an officer. If an officer was in a struggle with you, they would not be giving you your rights then. It would be after when you are under control and usually in the back of the Police car. There is no reason this cannot be the same when a K0 is used.

you should look at the use of force continuum before you claim buitality. plus TV steps everything us for show. the camera crew for COPS was at a neighbors house one time and they said it wasnt going to be aired because it wasnt juicy enough. Miranda doesnt cover what your talking about.

How is it brutality since they call the dog off as soon as the offender stops resisting?
Miranda is only needed prior to being questioned. I have never seen a K9 that speaks anything other then Arf, Arf.

dog, tazer, baton,OC,car,gun or just plain ***-whooping...take your pick. you will face one or the other when you choose to run.

however I do have reservations about "overuse/misuse" of K-9

as far a Miranda warning....the dog is always followed by an "interpreter"

thats the dogs job...and the police always scream "we will release the dog if you dont stop" when the subject is down, the police will read them their rights

The suspect is warned if they don't stop what they are doing the dog would be unleashed. The suspect is choosing to be attacked by the dog when they do not comply with the officers orders, especially after they are told what is going to happen. A dog attacking would be no different than mace/pepper spray or the use of a taser. It is better than the other option, lethal force.

What does miranda rights have to do with a dog? You don't have to have your miranda rights read to you until you are being questioned for the crime you are suspected of. It is a common misconception that police have to read you your rights when you are being arrested. You only have to be read your rights when you are being questioned for your crime.
