Police didnt read me my rights?

hey, the police officer didnt read me my rights, but i am a juvinile.
he didnt read them to me when he put me into the car, but he didnt hand cuff me.

Okay, like, what happened is that i was at the highs school with my friends, and they were all joking abuot taking a xmas tree that was already dead, they told me to check if it was loose, and i did and it came off, they were all like WOAW! and then i followed them then the janitors came and grabbed me and got the cops to come, then they took me to the station and callled my mom, im going to court.

Since you don't bother to tell the whole story I'll just put the most obvious out there. If there is no custodial interview (and as a juvenile you cannot wave your rights anyway) then he has to hold you until a parent or guardian can be notified.

Less law and order and csi and more actual learning would serve you well.

Odds are you were never placed under arrest if you weren't handcuffed. Also, you don't need to be read your rights unless they question you (while you are under arrest). Any information the officer obtained from you after you are placed under arrest, but before you were informed of your rights is arguable. If you were never placed under arrest, then the cop had every right to ask you "WTF" without telling you your rights..

The point of reading you your rights is to protect you from incriminating yourself. If you broke the law and the officer took you to your parents, or to the station and had you wait for your parents....then you probably should let it go.....nothing unconstitutional happened.

Don't have to unless they question you about a crime after arrest.
The thing about reading rights as your arrested is for TV, not real life.

The police are ONLY required to read your rights if your interrogated.

IF your worried about losing your rights, then don't break the law.

Depends upon the state. Usually they just do it to cover their asses in case you do anything dumb in their custody.(like confess)

The only time they have to read you your rights is before a custodial interrogation. Any other time, including during arrest, the police are under no obligation to read you your rights.

Besides, even if they failed to read you your rights before questioning, it's not a "get out of jail free card" like everyone thinks. All it means is anything that you say until you are read your rights is inadmissible in court.

Did you go to jail ??? if not then get over it! And stop finding loopholes for getting out of trouble with the cops , try staying out of trouble by doing the right thing and being a good citizen and you won't have to worry about having your rights read to you.

arrest + questioning= miranda if the police office only arrested and did not interrogate you or ask you any sort of guilt seeking questions he does not have to give you a miranda warning? asking your name and other identifying questions is not worthy of a miranda warning if the officer asks you a question like what did you use to break into the house and doesn't advise you of your rights and you answer it then the situation could be thrown out in court.

Were they arresting you? if not, then they dont have to read you your rights. They can detain you for questioning however.

You get you rights read to you upon arrest. If you are being questioned about an incident, they have no reason to read you your rights - you are not a suspect at that time, you are not under arrest.

Maybe you were just being detained as opposed to arrested. just because you are placed in the cruiser or taken to the police department does not mean that you have been arrested.

If you did you have an argument. If you didn't actually get arrested and charged then there was no need for them to read you your rights.

You don't have those rights in most areas as a juvenile, as you cannot be arrested for what is called status offenses. If you did something that would not be a crime because of your age, IE underage drinking, curfew, and so on. You have to be detained separately from adults and your parents called. Miranda rights apply only during interviews, since you cant be interviewed without parents, they don't apply

in all technicalities, the police only have to read your rights if certain categories are met. one of these categories is that the police has to think that you are a suspect in some kind of crime. If you were arrested and brought in for further questioning, they don't have to read your rights. It all depends on your actual case.
